There was a case I saw where the Lawyer booked an appointment before it was approved and they had to start again. I thought you said earlier it was less than 6 months but whatever it is you have to allow for, So approved I 601a, Consulate appointment after the x months and Immigrant Visa, assuming you have no other way.

Yup correct! If we take the I-601a route, the 44 months for the approval is literally the longest period which is insane.

So if 601 is denied she will be illegal. With a ban and will be deported. 

Who does not finish 6 months. That is over in a blink of an eye.

We know this now, but put the trust in our attorney! He did not guide us well.

I 601 seems to be about 18 months but first you need to be interviewed at the Consulate and refused for the overstay.

 

Not sure I see how a I 601 comes into this otherwise but the story is confusing so I could have missed something.

I don't believe 601 would even be in play, just 601a since they are already here. The stress this has and is causing me is absurd.
