They always mail out the cards, no matter what, so getting the cards does not mean one is approved, lol

Canadians Visiting the USA while undergoing the visa process, my free advice:

1) Always tell the TRUTH. never lie to the POE officer

2) Be confident in ur replies

3) keep ur response short and to the point, don't tell ur life story!!

4) look the POE officer in the eye when speaking to them. They are looking for people lieing and have been trained to find them!

5) Pack light! No job resumes with you

6) Bring ties to Canada (letter from employer when ur expected back at work, lease, etc etc)

7) Always be polite, being rude isn't going to get ya anywhere, and could make things worse!!

8) Have a plan in case u do get denied (be polite) It wont harm ur visa application if ur denied, that is if ur polite and didn't lie! Refer to #1

Hmm, I know they aren't going to back pay me - even though I filled out the cards for 2 months, I wasn't able to work, so I know I will not be getting money from that period...

Now I just have to wait until to tomorrow to make sure the direct deposit goes alright :)

Quick question...

I'm totally hating my job right now and we are waiting for our K1 visa at the moment (probably another couple months) I want to quit so I can go to the US for a month or so and spend some time with family back in canada before our paper work come through. Is there any chance I can qualify for EI?

I don't think so.

Number one, they do not look favorably on quitting a job, unless you can give them a reason (ie moving to the US to be with spouse), and your employer usually has to note this somewhere on your ROE. Quitting before you get your visa would be considered too soon by the EI people as mentioned in the other thread.

Then there is the point of being "willing, able and actively looking for work", which you would not be. You would be outside the country, so you would not be considered looking for work, and you are not authorized to work in the US.

Unfortunately you would not meet the requirements. Even after you move, you still have to submit proof that you are authorized to work, and that doesn't happen until you get your EAD (about 2-3 months after you submit your AOS). I applied for EI the day after I moved to the US, which was Feb 4th - I started to receive my EI payments last week.

I wonder...I'm on EI at the moment due to a layoff. Do you think they would allow me to keep my benefits due to moving to be with my spouse (like pause them till I get my EAD?) Probably not huh?

I don't think so because it is a completely different department you go through for Inter-state claims. It is a smaller office, I think there are only two or three ladies that work there to be honest. And it doesnt have access to all the EI things such as online or telephone reporting.

You have to be in Canada to receive regular benefits and you have to notify EI if you move. I suppose people could try and not tell them they moved, but when the government finds out, they would ask for that money back :(

hmm, actually re-reading what you wrote Danu, as long as you call them and tell them when you move, they most likely will just put your claim on hold until you get your EAD. You shouldnt have to reapply - just get them to move your case to Inter-state claims. I would call and talk to someone about the process when you're close to moving.

Just clarifying; I'm working up to a few days before I move, and will have my ROE and last paystubs, etc. I have kept lots, but my pay goes from the 1-15, and then 16- end of month, (30 or 31). It's been a while since I was collecting EI, and I can't remember if they only need my last pay info, or something else. My vacation pay is also part of my cheques, so I won't get a "payout" of that.

When I file for EI, I do it right away when I move, is that correct? Other than the ROE, they need the info on the I-94? Being how I'm moving in 4 weeks, I just want to be sure I have all the right info, before I'm Stateside. Ugh. And I thought waiting for approval, and the interview was hard. This is all too much like work!

Apply as soon as possible when you arrive in the US... I had to send the original of my ROE and a copy of the visa and I-94, plus fill out some forms (online).... You don't need paystubs, all info they need is on the ROE.

Ok, that's great. Thanks for the reply! I forgot to ask what letter is put in that box for reason to quit. I know my boss well enough that she wouldn't want to put the wrong one, in case it slows down or hinders my claim.

The letter "E" is on mine.... often people say on here that the ROE must state "quit to relocate to US to be married" but mine said no such thing and I was approved just fine

My HR person put "K" for other and then wrote "Relocating for Spouse" in the notes section. I actually didn't ask them to do that, she just did on her own so that was nice.

I should have my EAD card soon to send it in. They finally sent me a letter saying that I'm denied until I send them an EAD card. Took them long enough!!

Thanks!! I'll let my boss know that maybe a good thing to write that..just in case.

I sure wish I was in the group that got EI for that first 90 days!! :P Oh well. I'm hoping we'll have pretty much everything together for AOS before we get married, and then send it in at the beginning of Oct. Judging by time lines here, I *should* get my EAD in January, or February. At least, I sure hope so!
