I have filed a I-130 and and an I-864 for my spouse and shortly received a Request for Additional Evidence. In the RFE it says:

Based on the documents submitted, we could not determine that the petitioning sponsor on Form I-864,
Affidavit of Support, is qualified. In order to be a qualified sponsor, the petitioning sponsor's Form I-864 must
be properly completed and signed, and the supporting documents must establish that the petitioning sponsor's
income meets 125 percent of the federal poverty guideline for the sponsor’s household size. See Form I-864P
for information on the Federal Poverty Guidelines.

 

You have submitted Form I-864, Affidavit of Support, from the petitioning sponsor. We are unable to process
the I-864 because it has one or more deficiencies. In order for us to process your application further, you must:
Submit a completed and signed Form I-864, Affidavit of Support, from the petitioning sponsor. All
pages must be present and of the latest edition date.
Provide the petitioning sponsor's Social Security Number on Form I-864.
Provide a complete and correctly calculated household size for the petitioning sponsor on Form I-864.
Submit a complete copy of the petitioning sponsor’s Federal income tax return, including all supporting
tax documents (W-2s, 1099s, Form 2555, and tax schedules) filed with the return, for the most recent tax
year.
Note: Applicants using a family member's visa petition to adjust status must be listed as a family member on the
principal immigrant's Form I-864.

 

 

 

I-864 was signed, there was an SSN on it and the current income exceeds the requirement. I filed with 2021 as the last tax year since we have an extension for 2022. There were 1040-ies for 2021, 2020 and 2019, and current pay stabs in the filing.

I cannot understand why there is an RFE and what we need to send in differently. Can you please share your experience on that? Thanks!

I just get the same rfe too.. don’t know what to do. Do you use turbo tax 1040 and w2?

@Dimmiq did you check form edition, is it the latest? Did all the pages print properly with page footers? Tax return transcripts from IRS website are to be submitted instead of TurboTax returns. Only a thought, but it's possible USCIS didn't like tax extension too. Did you include copy of extension with submission?

Good point, I did check and it's the latest edition. The footers are in place. I sent them 1040-ies and it does say in the instructions they accept them. I actually submitted before April 15.

I'd still submit tax return transcripts from IRS website. Forum posts suggest they are preferred by USCIS over anything else. If you sent exactly what you sent already, there's high chance they won't take it into account.

 

Double check whether all the info on the forms is correct, including but not limited to household size. That one is easy to miscalculate.

They do ask for w2 (that I send but print out by turbo tax) and irs (turbo tax) and point out my mistake in filling out the form.. but they said my husband need to sign it(that he do) and rfe for my medical check up too

I sent them just the first pages of my 1040s. Can that be the problem?

 

For household size it's whatever is on my 1040 plus the spouse, correct?

Yes, this can be a problem. Send all pages of all documents that you use as evidence. This also includes bank statements etc.

Tax return transcripts are short, consider sending those.

Check the bar code at the botton of the page. I helped a friend that was the problem.

N-400 interview on December 12, 2022 combo interview i-751. Approved.

January 11, 2023 oath ceremony, Indianapolis. After that done with uscis😂🤭🤫

I took my oath ceremony in Indianapolis, it was a nice ceremony, where people from 35 coutry become american citizen.

01/11/2023 officially done with uscis :)

January 13, 2023 apply for us passport.( regular service).

Clearly there's at least a problem with not submitting all pages of support documents.

I haven't filed for 2022. What do you think will happen if I submit the extension?
