Updating the chart. Basically Embassy at the Paris immediately sent the interview in the first batch after being DQed. However, the physician in Mainland Portugal closed her practice and there wasn't any available spot in Paris until October 2nd. So, our case is still under administrative process after the seemingly okay interview pending medical results. Since then, radio silence... To complicate the matters, we would need passports for an unrelated issue. Moral of the story, if you are at Paris or any other embassy that handles quickly, just schedule your physicals after being DQed, worst case you reschedule the medical appointment but not be in dark at a process may take weeks to months.

Edit: I don't know why I cannot edit the chart but the DQ date was 08/04/2023, NOT 08/24/2023.

Where did you get that definition?

I’m not sure how to answer this, because there is no specific information on any official website that refers to how people going through consular processing use their residency status to figure out where their consular interview should be.  Like many things with USCIS, there are only vague guidelines. You apply in your “home country” but what if your home country has been the USA for the last 5 years? People currently living in the US are able to go through either consular processing OR adjustment of status, but there are no clear guidelines on what, therefore, is your “home country” if you have more than one citizenship.

But the IRS and USCIS use the substantial presence test to determine your residency for certain purposes. For example you are a “resident alien” for tax purposes if you’ve been in the country for 183 days or more. USCIS uses the 183 day definition for their continuous presence test when going from Green Card to Citizen.

This may be pertinent.

Wow super informative! Thank you -

9 FAM 504.4-8(B)  (U) Usual Place of Application

(CT:VISA-1753;   04-05-2023)

a. (U) As a general rule, an applicant in the United States should apply for a visa at the post in the consular district of the applicant’s last foreign residence.  That is the only consular section required to accept the case for processing, although another consular section might do so as a matter of discretion.

b. (U) You must, however, accept an IV application from any applicant who is a citizen or a national of the consular district, regardless of the applicant’s last residence abroad, when directed to do so by the Department.

c.  (U) The assignment of an IV petition to a consular section by the IV processing center in the United States will constitute such a direction by the Department.

I think, as usual, it comes down to the person at the consulate on the day.

How long it takes after DQ to get an interview at the Johannesburg consulate?

Good morning everyone,

I have been following this thread over the past few weeks. Does anyone know if your ballpark estimate of around 25 days to DQ for EB cases also applies to EB-5 cases? My documents were submitted by Fedex to the DoS mailroom in VA and signed for on Sep-25. Since then, I have sent various inquiries to the NVC - only to get back the same generic texts you all know. Any idea if EB-5 may land on a separate desk / department?
