Proof of employment when filing AOS

Hi there,

Just wondering - my husband is my sponsor and when we file for AOS we submit his letter from his employer as proof of his employment. If he is to resign after that and he is out of a job for a month or so, will that create any issues for us? Do we need to advise USCIS etc?

Hello

The employment letter is optional,just like pay stubs,bank statements etc. They used to look at your last three year tax returns. But if your last year's tax return have sufficient income,you should be fine. They rarely check the employment for if you have less income, they will ask you to find a co-sponser. Hope this helps. He used to live in Australia with me and only returned to the states in Nov06. That means that his last tax return on his american income would be very little if we were to do AOS in October. Will he be able to use his australia tax return as well? He definately makes more than enough money over the poverty line.

If he's a US citizen, he should have been filing tax returns for the US while he was in Australia. Those need to be filed before AOS is filed.

Well, we only sent them tax returns, and got an RFE for paystubs and employment letters :wacko: It's always better to overdo when it comes to dealing with USCIS.

Well, we only sent them tax returns, and got an RFE for paystubs and employment letters :wacko: It's always better to overdo when it comes to dealing with USCIS.

Equally I only sent in my recent tax return and had no problems. Still its good advice to give USCIS more information than they ask for *unless it might make your case look worse*.

I only had to take a letter of employment to my K-1 interview. I did not need this for AOS. They had copies of the tax returns from my K-1 so I also did not take those to the AOS interview with me. They pretty much had everything in my file that I took to the embassy with me in Germany.

*Met in Tanzfleck, Germany October 24, 2003 - Continued dating until he got out of the ARMY in Nov. 2005. Continued LD relationship.

*Came to visit me in Germany for New Years 2006

*Filed for K1 Visa on 4/4/06

*NOA1 - 7/6/06

*I-129F NOA2 Approved - 9/14/06

*Came to see me Thanksgiving week in Nov. 2006

*K1 Interview - 2/2/07

*K1 Visa received - 2/11/07

*Date of US Entry (POE Chicago)- 3/5/07

*Wedding/Marriage - 3/17/07

AOS (My case was expedited due to husband going to Iraq):

*Filed for AOS - 4/20/07

*Found out in the beginning of June that husband is going to Iraq

*NOA for I-485 - 6/11/07

*Made Infopass appointment to get case expedited due to deployment (Infopass appt 6/12/07)

*Biometrics - 7/7/07

*Interview date - 7/11/07

*I-485 Aprroval date- 7/11/07

*Green Card Received- 7/19/07

Removal of Conditions:

*Filed petition to remove conditions on 6/9/09

*NOA- 6/15/09

*Biometrics Appt. in Birmingham - 8/6/09

*Lifting of Conditions Approval Date - 10/22/09

*Waiting for Green Card!

Had our daughter on 4/4/08 and have another baby due 11/19/09!!!
