Question regarding household size and total income - form I-864

Hi, our I-130 was approved (finally) and we are filing form I-864 and I have some questions. 

 

1. Part 5-1 ask number of people who are sponsored in the affidavit, we entered “1”. I’m the spouse and the only intending immigrant. However 5-3 (people who are not sponsored) said “If you are currently married enter “1” for your spouse”. Should we keep this blank? Or still enter 1 and at 5-8 enter “2” for household size? Sorry for the dumb question but the wording is very confusing to me

 

2. My husband is currently on active military duty. He started receiving BAH and BAS this year (previous years he lived in the barrack). These allowances are transfered toward his bank account every month however are not taxable income so they will not show up in his tax return. Do we need to count them in the annual total income in part 6-7 or only report his base pay?

For the question 1 -  At the same time the instructions says, do not double count.  In my case, just me immigrating my spouse, I did not enter 1 in 5.3.  At the total came as only 2 people as family size

Correct for number 1.  For number 2, there are two sections of the form that ask about income.  Enter information from the tax return in the tax section.  For the current income, use his leave and earnings statement.  Take the gross pay, then multiply by the number of pay periods in a full year.  Monthly X 12, weekly X 52 etc.

 

Current income does not come from a tax return. Tax returns are about the past.
