Do I need a statement from my daughter's mother?

Hi Vjer's,

This is private matter and I'm not proud of it but I need some advice from anyone who may be familiar with this subject.

The topic here may sound odd but that's how I refer to her because we were never married. I never married my daughter's mother. We split up seven years ago and never looked back. We never had any legal documents drawn up regarding custody but we've always worked things out.

Anyways, regarding this issue, any idea how the consulate will look at it? I'm thinking maybe a notarized statement from her along with proof of her address being different than mine might be a good idea.

I don't want something to surprise my fiancee.

What do you think?

I don't get the question. Need a statement for what purpose? The only reason I can think of for getting a statement is if you are the foreigner and you're bringing the child to the US. Then, yes, you'll need the other parent's permission formally and with that country's form of notarization.

I don't get the question. Need a statement for what purpose? The only reason I can think of for getting a statement is if you are the foreigner and you're bringing the child to the US. Then, yes, you'll need the other parent's permission formally and with that country's form of notarization.

The child I'm talking about is my child here in the U.S.

I'm asking about the statement because I'm concerned that the consulate may wonder whether I'm involved with someone else here in the U.S.

The child I'm talking about is my child here in the U.S.

Well, since I was never married, I don't have a divorce decree. I'm wondering if the consulate will see that I share a

daughter with another U.S. citizen and wonder if my relationship with my fiancee is bonafide.

Maybe a better question would be the following:

Do I need to prove that I am no longer in a relationship with the mother of my daughter here in the U.S.?

If there is a potential issue with the CO, I could possibly help eliminate any doubt with the consular officer by having her mother write out a statement that we have gone our separate ways.

The foreign consulate won't care. You don't have to state anything about children on your side of the applications, so don't make a big deal out of it.

As far as I know, you only have to include evidence relating to the end of previous marriages. As you are the petitioner and your child is not part of the petition, there is no reason to include them on your I-129F. If you are paying maintainance, you may have to put that down on the affidavit of support. Other than that, as you were not married before, you do not have to include any information about your former partner or your child on the visa petition itself, nor do you have to provide any documentation to state you have always been single.

2004 - T applied for student visa for semester of study in US

Jan 2005 - T flew to States to begin course

March 2005 - T flew to CA. D picked up at airport. Finally met in person!

April 2005 - T flies back to University

April 2005 - D flies out to be with T

May 2005 - Both fly back to CA and begin living together

Sept 2005 - T flies back to UK to resume studies

Oct 2005 - D flies out to UK to be with T - Decide we want to get married!!!

April 2006 - D and T move to Ireland

March 2007 - We download paperwork for I 129-F

April 2007 - Send off forms to Texas Service Center

June 2007 - Still waiting to hear back

July 2007 - Still waiting to hear anything AT ALL! Very angry

7th July 2007 - We called the USCIS and were given our receipt number. We also signed up for the USCIS online service. Learned that our petition arrived on May 15th and last action was May 25th 2007 - Much happier

4th October 2007 - Petition Approved!!!!!!

24 April 2008 - Interview at US Embassy Dublin

17 June 2008 - Arrived back in US together

10th SEPTEMBER 2008 - MARRIED!!!!!

Also, you can bet your life that a lot of people petitioning for fiance visas have children from previous relationships where marriage was not an issue. If the USCIS had to deal with paperwork about children born outside marriage with these petitions, they would be even more inundated than they already are.

The main issue would be if your fiancee has a child that she wishes to bring over with her. Even then all that would include would be to name the child on the I-129F. That's what we are doing for my son.

Don't panic about your situation. It's easy to worry about what to or not to include, but unless asked otherwise, just present what is required as stated by the forms.

I get it. No, you don't need anything from the child's mother. You may not even have opportunity to disclose that the child exists. For China, a family composition sheet is filled out and turned in at interview but not all Consulates use them. The PI might. If so, make sure to list the child but not the child's mother as a former spouse. Your fiancee should know the circumstances and explain them concisely if asked. Concisely, in this case is as simple as "He has a X year old daughter but was never married to the mother." She should probably know the mother's name and maybe how long ago you split up.

It's really not an issue. Focus on portraying a bona fide ongoing relationship with your fiancee.
