Case FE Review note for W2 when didn't live in US?

Timeline

All my documents say accepted, but I didn't get DQ'ed or an interview date. They're requesting I upload all my W2's and 1099's for 2021. The thing is, I've lived abroad outside the US for all of 2021 and have no W2's or 1099's to upload, what should I do?

Theoretically you shouldn't be obligated to upload either W2 or 1099 if you use tax transcript, but if you live outside the US and upload tax return for the last year, it's better to write an explanation that you don't have them since you were working overseas.

I actually did mention this in my cover letter that i submitted with the rest of my packet, but I guess they glossed over it and didn't realize. I tried calling NVC to learn their phone line is down now 😕 Maybe not much other option than to resubmit another letter explaining the situation and maybe upload my paystubs for 2021 from my foreign job (in addition to the ones I already uploaded), send them an inquiry, and in the meantime possibly wait out another couple months til they review it again..

If you work abroad and your foreign income will not continue when you move to the US, your individual qualifying income on the I-864 should be $0.  Did you write $0 as your qualifying income?  If not, that's the reason for the RFE for W2/1099.

i just double checked, nope! i put $0 as my qualifying income!

In that case, no need to submit paystubs from your foreign job since you are not using your income to qualify anyway.  If you had submitted foreign paystubs, yet put $0 as your qualifying income, that could be why NVC got confused, hence the RFE for W2.  Delete those paystubs from CEAC.  To address the RFE, upload a letter explaining that you do not have W2s and that you are not using your foreign income to qualify anyway.  Explain what you are actually using to qualify (assets or joint sponsor).  Use the "W2" tag on CEAC when you upload the letter.

Hmm okay, you think it's better to forego my personal proof of income then? I had just followed the letter from one of the guides on visajourney and uploaded everything accordingly, oops
