My wife came to the US on K1 visa. We are now filling out I-864 for AOS.

I have not yet filed 2021 tax returns. I plan to file it before the October 17 deadline.

Question 1: Am I required to file my taxes first, request a transcript, and include the transcript with the I-864? Or can I simply include my 2020 returns?

Question 2: Where it asks for 'My current individual annual income', is it asking only for what my employer pays me or the sum of all of my income (including real estate, trading, etc)? Pre-tax or post-tax? Can I just write what is in W2 box 1? My employer pays me in cash + RSUs; which should I include?

please file your 2021 tax immediately. over april 2022, uscis will definitely request for RFE if u didnt attach ur 2021 tax return / transcript.

current annual income is ur current income, w2 = not current income.

do you get income from your real estate / trading? income its not the same with asset/

Where can I find documentation on this? I spoke to a lawyer and was told it's ok to just attach 2020 + extension letter for 2021.

its basic knowledge that i know of from all the friends, co workers information

i never file tax over the cut of date ( mid april every year)

i think u can check IRS website.

Of you have requested the tax return extension and got the confirmation, it works.

For current income, include any income that you will include when filing your tax return. Provide evidences of income accordingly.

Other than the W2s pre tax deduction, you need to provide evidences of paying taxes on the income even if your tax return filing is extended to Oct.
