For my mother's case, we received this message since October 2021:

 

Thank you for your interest in immigrating to the United States of America. The Department of State's National Visa Center (NVC) received your approved immigrant visa petition from U.S. Citizenship and Immigration Services (USCIS). NVC's role is to ensure you are prepared for your immigrant visa interview at a U.S. Embassy/Consulate General, and to schedule your interview appointment.

 

 

Since then, it has been stuck at this stage. My brother is the petitioner and he owns his own business. He has submitted his statements and tax returns. They keep asking for 1099 and he has responded stating that he is a business owner and does not get 1099. Has anyone been through this process as a business owner? Any suggestions for how to work around this? It seems as if they are not looking at his documents or reading the letters that explain his situation. If you know a way to escalate this and actually speak to someone, please share. I'd appreciate any help.

12/05/12, Day 022-Biometrics appointment (12/20) NOA received.
12/06/12, Day 023-Successful Walk-in biometrics @ Brooklyn ASC.
12/18/12, Day 035-Online case status available (I130-initial review; I1765-initial review; I485-testing and interview)
01/22/13, Day 070-Notice of EAD approval via text & email.
01/25/13, Day 073-EAD card production.
01/28/13, Day 076-EAD mailed.
01/30/13, Day 078-EAD received.
04/01/13, Day 139-Text and email notification for May 6th interview received.
05/06/13, Day 171-Interview @ Federal plaza, NYC. Further review but we're highly favored biggrin.png

06/05/13, Day --- - Notification of stokes interview received in mail.

07/31/13, Day --- - Stokes interview @ Federal plaza, NYC. Approved!
07/31/13, Day --- -Green card production email and text received.
08/06/13, Day --- -Green card mailed.
0x/xx/13, -Green card received. :-D

Read the RFE properly. Usually they send a generic letter which lists any 1099 or W2 or any applicable documents. They aren't saying he has to send that specifically. If there are some mistakes on i864 or he hasn't provided supporting documents properly, he will get that generic RFE. To get a good advice, list what was claimed on i864 regarding income, household size and what documents were provided to support that.

Does he file taxes as self-employed?  If so, did he submit all schedules along with his tax returns?

 

From the I-864 form instructions (https://www.uscis.gov/sites/default/files/document/forms/i-864instr.pdf) -- "If you selected Part 6., Item Number 2. that you are self-employed, you should have completed one of the following forms with your Federal income tax return: Schedule C (Profit or Loss from Business), Schedule D (Capital Gains), Schedule E (Supplemental Income or Loss), or Schedule F (Profit or Loss from Farming). You must include each and every Form 1040 Schedule, if any, that you filed with your Federal income tax return."
