K-2 is generated at the consulate by indicating child on the visa application forms sent to by the consulate, as well as being listed on the original I-129F petition filed by the American petitioner.

thank you-that link answered my concerns. basically, a k-2 is intitated automatically when your fiance's children are listed on the i_129f, yes?

Yes. If they are listed, the Consulate will conclude they are coming and act accordingly, even if they are not.

Facts are cheap...knowing how to use them is precious...

You need to seperate in your mind the petition process and the visa process. The visa application requires an approved petition.

You must do nothing other than list the child(ren) on the I-129f in the petition process. However, a K-2 visa application is initiated when you send in your forms (DS-156, etc...) it is not automatic much like a K-1 visa application is not automatic. There is a process but it is not totally 100% automatic, they will begin the application process by sending out application materials (once they receive the approved petition) but that is when the "automatic" part of the process ends.

No, it is not automatic. A K2 is initiated when someone submits a visa application to the consulate for the child. This can be done by the K1 parent at the same time they submit their own visa application (the 'traveling with' scenario), or it can be done by the parent or someone else acting on the child's behalf some time after the K1 parent has applied for their own visa (the 'following to join' scenario).

In the case of following to join, the K2 visa must be issued within 1 year of the date that the K1 visa was issued. This time requirement needs to be taken into account when deciding when to apply for the K2 visa.

I'm with you - the consulate will conclude that the children want a visa when a visa application is submitted for them.

Listing children's names on the petition for the parent does not imply that the children will want a visa.

How Consulates deal with children can vary but in China for instance, if you list the child on the petition, they presume you want the child to accompany the K1 or 3 visa applicant and "act accordingly" by sending a visa application packet for the child or children. They do this "automatically". If you don't return the application and OF169 for the child, they don't give up. You still have the option of applying later using the packet already sent or another one requested later.

They have even been known to hold up the interview appointment because the child's application was not yet received. If the child is not planning to accompany now or later, it is good to directly inform the Consulate.

It is pretty obvious that the embassies around the world treat K-2's differently. But for those interested please note that a K-2 visa can be issued up to one year from the original issue of the K-1 visa. The child needs to be under 21 prior to issuance of the visa and if the child is a minor, then you need to check the laws of the country regarding parental rights. You may find it necessary for the non K-1 visa parent to authorize the child to leave the country.

Well, the sentance wouldn't make sense then but, I disagree anyway. Some if not all consulates do infer that children will accompany their K visa parent and act accordingly until informed otherwise.

If you disagree, please provide a counter example.

How about my own... The US Consulate in Kyiv sent out P3 for the fiancee only... no P3 packet for the K-2 child...

Your experience is with China.. so all we have is 1 that does and 1 that doesn't. Even anecdotal evidence on this issue appears to be lacking.... just does not appear to be enough datapoints to support your "if not all". Why not do a poll?
