Not accurate. You can definitely apply for N400 while ROC is pending. Can you please link the policy?

First of ALL, there is no such thing as a combo interview.  The policy states that you cannot apply or be approved for n400 until you have completed ROC.  This ploy to push for quicker adjudication on the I-751 does not apply in your case.  Until your divorce waiver has been finalized, your N400 will be denied.  They will not combine the interviews, as you tried to file under the 3 year married rule.  You have wasted your money twice.  You will have to wait until Divorce waiver if finalized.

I'm confused by all the statements you made. Not sure how you sounded so sure about these. But please clarify if you can.

I did not file my SECOND n400 under 3 year married rule. I filed it under 5 year rule. My first n400(filed under 3 year rule) got denied then i filed it again under 5 year rule when I became eligible again.

So as of today, I have second N400 pending with 5 year rule. AND a second i751 WITH divorce waiver.

How did I waste my money twice? Why is my second n400 or I751 getting denied?

I know it is true that until I751 (with OR without divorce waiver) gets approved first, n400 cannot be approved but they do it in order when you have combo interview.

Does anybody else agree that my n400 will be denied because I have a divorce waiver I751 that is pending?

That's also what I thought.

I filed I751 Divorce waiver(June 2020) after I got divorce and then I filed n400 under 5 year rule 6 months later.(January 2021)

Do you also think my n400 will get denied? or I'll have issues?

I thought many people are in this situation :(

Ok, so either I’m not understanding something or there is a language issue. This is exactly what I was talking about yesterday when I asked you to spill the beans and tell your whole immigration history. Here we go:

Why did the first N400 get denied? That is the key question. I bet you $100 that it is the same reason why they’re sitting on your case this time.
That is a key question, together with 👇

I am not going to answer that question until I read your whole immigration story, together with the reasons for previous denials.

Why a second one?

i hope this will make it clear. If this makes sense, i will make it in one post and only ask questions there.

1 - Married US citizen spouse in 2016 and got conditional green card. (it was a real marriage)

2 - filed I751(FIRST) to remove conditions in 2018.

3 - Marriage falled apart and started counseling etc.During this time, while i751 was pending, applied n400 under 3 year rule while married and living together. (We were living together and working on marriage)

4 - I had to go to n400 interview alone since spouse went to her parents house and I said the truth during interview and officer said I need to submit divorce decree in 90days or everything will be denied.

5 - Filed divorce but during covid things took long and USCIS denied my i751. And also denied n400.

6 - Divorce became final and i recieved denial letter for both i751 and n400. then I filed second I751 WITH DIVORCE WAIVER by myself in JUNE 2020.

7 - Became eligible to file n400 under 5 year rule and filed n400 in JANUARY 20210

Now my second n400 and i751(divorce waiver) both pending.

Makes sense? i hope I was able to explain and sorry for misunderstandings.

hoping I can get answer

You’ve had it. You just aren’t listening .
There is, for the most part, nothing you can do.

My own n-400 (5yr rule) was scheduled for interview last year, and the interview letter was issued & dated a week AFTER my second I-751 was denied. That’s simply ridiculous incompetence.
Then, at the n-400 interview they had no knowledge of, or care about, the I-751. It should have been a combo interview, but for some reason, some muppet denied the I-751 without referencing the prior filing which contained the evidence, without interview or RFE, breachIng multiple well established USCIS adjudication procedures.
They simply didn’t want to help, and they didn’t help.

Another example: I replied to an RFIE for my latest I-751 today…. enclosing the documents that they requested - in this case divorce decree and divorce filings - the very same documents that were in the very filing a year ago, in a very specific folder with a big label on the front stating ‘divorce paperwork’ in big capital letters. They also have four prior copies of that exact paperwork in my A#.

How do you argue with that sort of utter stupidity?

How do you reason with it?

You can’t.

You are looking for logic where there is NONE.

The uncomfortable truth is that you are simply a barcode to them. They don’t know, and don’t care about you, or how long it takes. The whole organization is about as sociopathic and unempathetic as it gets, and you are on the sharp end of it, and at some point went to the back of an even harder line, because you received a denial in the past.

Stop driving yourself mad, and get on with your life, thinking about it as little as possible. It happens when it happens, and there is nothing you can do to speed that up.

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks).
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE...
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time.
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case.
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied]

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

I AM JACK'S COMPLETE LACK OF SURPRISE

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) ....

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

2024: FML. Seriously. I'm done.

Thank you and i'm facing this hard truth and I'll do my best to leave this behind but I was just told by another person that my n400 will be denied because my i751 is divorce waiver and it is pending. Is that true?

This is what another user said and I was hoping this is not true.

Not necessarily. I mean, your immigration history is a little complicated, but it might still be doable.
Some questions can seem intimidating and I’m not saying that you have to answer them publicly. But the answers might give you an idea of why they’re sitting on your case.
- What’s your country of birth?

- What visa were you on when you got married?

-What’s the time lapse between your arrival into the US and your marriage?

- Any previous visa applications?

- Any red flags in your relationship? (Huge age gap, not speaking the same language , etc)

You said you filed a FOIA. I’d wait on it, and then maybe if you don’t have an answer a year from now you can think of suing them.
