Did you ignore sending bonafide marriage evidence?

MrsJibowu was at VSC and filed after the H1B rush, and VSC was not overloaded with petitions as they sent so many to CSC during that period. Some even without issuing an NOA1 (myself and My Honey among them).

My I130 was approved in 80days without any additional information.

There is a line on the I-130 that asks "last address" or something - I gave her address in Jakarta, listed (2) weeks of dates, then flippantly says "Cant share address, waiting on K3 visa". Maybe it made one of them smile. :)

USCIS is getting stacks of c--p, but most of it they did ask for. People are afraid of RFEs and the requirement of proof of a bona fide marriage is in the instructions. If they wanted to not get it for K3 or from newlyweds, they could put out an updated K3 guide saying bona fides don't need to be proved for newlyweds. This thread is showing that you can get approvals without it, so it is not required for cases where the newly weds have not lived together.

We sent in a copy of our marriage book (issued by the gvt Indonesia) and certified translation only. No photos, letters, phone bills, or any of that nonsense. Identical evidence sent in with the 129F. They were both approved. No wonder CIS is locked up, they are getting stacks of c--p they dont ask for or require.

Interview prep materials? THEY are extensive, that's where proof of marriage ongoing relationship is determined. Consulate advised us so.

Thank you. The thread is about filing the petition. Unfortunately, by the time there's a visa interview, most aren't really newlyweds anymore. By the time of AOS, they've lived together in the same country.

We sent just marriege certificate, we did not have all those things by that time yet, we were just starting our life together in my country.

But now after almost an year living together we have thousands of pics, travel tickets, hotels reservation, car loan we got together, bank account, credits cards, insurance etc etc.

I have a box full of papers ready to take with me.

We got a RFE for 130 but it was about wrong size pics and my husband previous marriege divorce papers.

I got an RFE that they emailed me and said they sent on Dec. 12 and here it is Dec. 20 and I have not received it yet. Did you call a week or two after you received the email, and if so, did they tell you to wait 30 days? I called today about mine and he told me to wait until after Christmas and if it still has not arrived, to call back and they would resend it. Thanks for your time.

RFEs do take a little while to arrive by snail mail. More than a week, and of course you are in the middle of the holiday mail rush which slows things down further by a few days. Right after Christmas sounds about right if not Christmas eve. The official line is 30 days, but that would be unusually long time for mail to travel even around Christmas.

Im a lil late reading this thread but in regards to the initial question i sent in affidavits and wire transfers in an attempt to show comingling of financial resources as we were unable to open up a joint account when we tried due to banking regulations. Since we filed the i-130 in early november we have since had a child born to us and i have a birth certificate that would go a long way to adding to the evidence of a bonafide marriage. I wonder if I can send in that birth certificate as a supplement to the I-130 with out an RFE, does anyone know. The service center is only an hours drive away hell i could stop in and give it to em personally ahahahaha j/k. anyways does anyone know if i can mail that in without an RFE maybe just a copy of the NOA1 with reciept number??

Hopefully you registered the baby at the USE Manila if you are the biological pop as the baby is a USC. Just apply for a passport for the baby at USEM.

Also you can get a d. ITF [in Trust For] savings account without wife signing or having a SSN. I did and it made it easy to transfer money to wife after

she got the ATM card.

Babies BC will definitely hold weight thruout the process if your name is on.

Oh yeah he's definitely mine, a carbon copy of me as a matter of fact. In so far as registering the birth well he's a lil over a month old and we're just starting the CRBA process now, we have all the other supporting documentation we only need to procure a certified birth certificate from the NSO, which takes 40 days if im not mistaken from the time the draft copy is submitted to the civil registrar and NSO which we're pretty close to now. When i said I have a birth certificate I mean i have a draft copy as its still under process with the NSO. What I asked was do i need an RFE before i submit paperwork or can i just reference and include a copy of the NOA1 ? Maybe ill ask this in another seperate post

Perhaps you missed the point of the thread but the actual point was that newlyweds who have never lived together or even in the same country don't need to bother with the bona fide evidence until interview time.

The current I-130 instructions encourage petitioners to include documentation not previously requested on the old form. See below.

NOTE: In addition to the required documentation listed in1) through 4) above, you should submit one or more of thefollowing types of documentation that may evidence thatbona fides of your marriage:

1) Documentation showing joint ownership or property; or

2) A lease showing joint tenancy of a common residence; or

3) Documentation showing co-mingling of financial resources; or

4) Birth certificate(s) of child(ren) born to you, the petitioner, and your spouse together; or

5) Affidavits sworn to or affirmed by third parties having personal knowledge of the bona fides of the marital relationship (Each affidavit must contain the full name and address, date and place of birth of the person making the affidavit, his or her relationship to the petitioner of beneficiary, if any, and complete information and details explaining how the person acquired his or her knowledge of your marriage); or

6) Any other relevant documentation to establish that there is an ongoing marital union.

We've heard a lot about how people who have never lived together dealt with the above request but I'm curious to hear from people who filed in 2007 using the new form but either didn't see or ignored this request.

Has your I-130 been approved anyway? If not yet and no RFE, no need to answer. If you got an RFE, please let us know.

Of course, the evidence requirement would make sense in cases of DCF, which usually means that the USC is living with his/her spouse aboard.

Many people who filed the I-130 directly in London with the new form received RFE's for the evidence. London specifically tells the petitioner to NOT include anything extra that is not on their checklist and this evidence is not on the checklist - we therefore didn't send it. For some reason, we did not receive an RFE for not including it.

That's probably fairly confusing, but that's the way it went.

Remember the I-130 is also used by those marrying in the US and simply filing for AOS. No visa.

So far we've only seen RFE's for this evidence for DCF cases and only in London.

We wrote to USCIS London with a letter asking a few questions, before we started the I-130 process (DCF). It took them ages to write back (about 6 weeks I think) by which time I had found out the answers anyway and mailed in the I-130, without any additional evidence of bona-fide marriage. When they did write back, they included the "old" checklist sheet which mentioned nothing about such evidence, and they had highlighted in yellow the bit about not sending additional paperwork.

So I am hoping that we don't get RFE, else I will be a bit miffed!

I was going to send in the paperwork proving that my Husband is the guarantor for my apartment in England and that I'm on his lease in the States.

Some people don't realise that the UK and US have access to the same credit check company ... so it meant I could use my National Insurance Number over there and he could use his Social Security Number over here .... however, I didn't send it in .... I didn't want to overwhelm them at USCIS.

At least it proves that it is possible in some countries to show some form of living situation financial tie .... and we are newly weds.

Since I was not able to add Govi to my checking account the only other evidence I included was a copy of the form where I designated Govi as beneficiary on my life insurance policy at work - no SSN needed. I am hoping when I am in Nepal(less than 3 months away-woohoo!!) we can open up a joint account there and will be able to show that as evidence at the interview.

That sounds like a good idea .... surely it could help if you're lacking in evidence ..... another financial tie
