Hi! Any advice much appreciated.

Preparing documents for my appointment, and on the page describing documents it says this. 

 

Quote

"If the name on your birth certificate differs from the name on your passport, and the change was not made through marriage, legal evidence of your name change is required.” 

Problem : My birth certificate does NOT include my middle name. However, my middle name is on all of my passports. Currently live in UK and I'm a British citizen, again all my documents including British Passport include middle name.  Been to America multiple times with the same.

 

They did not question this at all when my spouse filed our I-130 , but I don’t know if they will notice at my interview and question this. 

 

Question What should I do about this? I do NOT have any “legal evidence” of my name change. I’d rather not spend more money on a solicitor doing a write up, but maybe I have to? If so, i've no idea what to write.

If you listed both names as ones you have used in past, it will probably not be a problem.  However, exactly how did your middle name come into existence if it is not on your birth certificate?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Typically they will issue the main name you use for the visa, and that should match the name on the passport.   I would list the BC name under "other names used" on the DS-260.

 

Also, did you do a direct consular filing - DCF?  That is, skip USCIS completely and submitted the I-130 to the consulate?  If so, could you complete a timeline and make a comment for reference.  It is very uncommon and it would nice to see that some embassies are still accepting DCF, and what criteria they use for approval.

As a follow up,

 

How easy or difficult is it for you to update you BC with your middle name?  I would look into this in order to mitigate any potential issues that may pop up.

In some African cultures, names are given post birth. In my case, had my middle name a little later. 

 

For clarity, this is what mine is like, so not necessarily different names. if you see what I mean. 

 

Birth Certificate :

Last Name : Smith 

First Name : John 

 

Passport  

Last Name : Smith 

First Name : John 

Middle Name : Owen 

 

So in the past, i've listed as in my passport, which would be include exactly what's on my BC.

Listing under a separate name would be tricky in my case, as they are both the same first and last name, as in the example I used.
