Hello dear members,

 

I am a USC applying AOS for my wife and my step-daughter, who is a minor.  I am almost done with my wife's AOS package.  As for my step-daughter, should I apply her as a derivative applicant under my wife (the principle applicant) OR should I prepare her own I-130/I-485 package?  I don't really understand this concept of derivative applicant.

 

Second question.  visajourney AOS step-by-step guide states that AOS package needs 4 passport photos for the beneficiary - 2 for I-130 and 2 for I-485.  However, youtube online AOS step-by-step guide is asking for 8 passport photos - 2 for I-130, 2 for I-485, maybe 2 for AP and 2 for EAD?  Should I submit 4 photos or 8 photos?

 

Third question, I-130 fee for my wife is $535 and I-485 fee is $1225.  I am planning to submit my wife and my step-daughter's packages together.  Do I need to include additional I-130 fee ($535) and I-485 fee ($735 minor fee) for my daughter if they are applying together?

Separate petitions, separate fees, separate packages. There is no derivative applicant. You can mail both packages in one big box/envelope though.

 

PP photos depend on what forms are being submitted. If filing i130, i485, i765, and i131 together, provide number of photos and supporting documents as required for each form.

I meant two for each card.  There are three cards being applied for: green, EAD, AP
