Hello guys,

I am wondering how I can proceed after wife left country without advance parole. It was an emergency since the grandmother is very sick and she is currently pregnant. Should I start thinking of applying for a spouse visa instead of wasting time?  We were already in the process of waiting for a green card. I do know that she won't be let back in the country as she has abandoned the case. Please help :(

Since this was a K-1, then yeah the AOS is toast. You will need to file a new I-130 to get the ball rolling for a CR-1/IR-1.

Contradictions without citations only make you look dumb.

I know of a girl that left the US for the same reason (sick grandmother) while waiting for her EAD/green card, and was able to apply for the advance parole while outside the US and allowed back in. My suggestion is for her to go the US embassy where she is, with all the paperwork of her relatives illness and various NOA of her application in the US and see from there.
