Hello ,

 

My wife and I met in February 2019 and got married in December 2019 . I got my conditional green card on June 2021 . Our problems started with my wife during the pandemic but we always handled problems between us until august 2021 and we decided to separate houses . I started living with my sister and she is living  with her friends. We still try to save our relationship but looks like we do not see eye to eye anymore . Also she told me that she doesn’t love me as before .I think that my only option is to divorce.  I feel so sad and depressed like never felt before in my life . ImmIgration process is hard and going through divorce is harder. Can someone tell me what would my changes be with I-751 waiver ? I do not have many documentations other than I gave at my first interview. Only have couple bank statements both names on it . Also pictures in social media  that were posted by my wife .  During my interview I gave officer following documents:

-1 year lease agreement ( both names on it)

-2 car insurance together( both names on it )

-2 actively used bank account statements ( both names on it)

-family pictures( with her family and mine)-officer didn’t even look at it . 
-Electricity bill

-Internet bill. 
-2 years tax return together.

 

i guess that is pretty much all. Any help would be appreciated.

So you went alone to the interview and told the IO you will be switching to a Divorce Waiver?

No , i went to interview with her in June 2021 and got approved in the same . I received 2 years conditional green card since the marriage  was less than 2 years .

So now you are going to divorce and remove conditions with a divorce waiver, best to get gold of all the documentation you can to show that you remain in marital union after you got the GC.

Yes , I’m going through divorce but I don’t have much more documents other than I provided for my 2 years gc interview. That was my concern .

That is a start. Build up on that. Here is a nice example of a solid Joint filing. Use it as a guide. I am sure that you have more evidence than you think. The devil is in the details and explaining to USCIS in full sentences what the evidence means. Don't just send them stacks of papers without telling them what they mean. They won't connect the dots for you even if it is obvious.

I-751 Joint Filing.

06-15-2021 - Case was updated to show fingerprints were taken. 

05-26-2021 - Received NOA/extension letter. Notice date and postmarked 05-20-2021.

05-23-2021 - Received text message with Receipt #. YSC Potomac Center.

05-21-2021 - Checks cashed (processing on joint checking account)

05-07-2021 - I-751 received in Arizona.

 

Marriage-based AOS - Concurrent filing.

05-07-2019 - AOS Approved. Resident since date 05/07/2019.

05-06-2019 - AOS Interview

04-23-2018 - "Case is ready to be scheduled for an interview"

03-16-2018 - Priority Date.
