My wife (USC) is petitioner for my son and myself, we 3 live outside US  and planning on moving to the US ( just got IR1 and my son IR2). Question is, on our POE does my wife need to travel with us, or Can i and my son travel without my wife ?( its hard for her to travel right now because of medical condition).

 

The idea is for us just to get our i551 stamped on USA and come back after a few weeks to wait on our origin country for a while for my wife to recover and for SSN and GC to arrive at US address.

 

Your help would be much appreciated.

No.  The petitioning sponsor must precede or accompany the immigrant(s) upon first admission to the US with their immigrant visa.  It's part of the domicile requirement of the I-864.  The inspecting CBP officer at POE may ask you about the whereabouts of your wife.

I agree, you don't have to travel together, but your wife as the petitioner must enter first.

Thanks so much guys for your input, you really clarify this to me, i checked the other post @chancy referenced and it explains a lot, basically we all have to travel together that first trip, even though we might return after a week i know now that it won´t be a problem to travel back and forth ( not abusing of course) until my green card arrive.
