Hello,

 

I know this topic or question was asked many many times, but maybe somebody has a good advice on the current situation.

Our petition got approved recently, something I have not expected at all. There are so many rumors that you should not travel

during your wait times. 

 

Our attorney is telling me how risky it is to actually fly and tells me it puts me into risk of loosing the entire K1 visa and getting banned for 5 years.

Is it true?

 

Also I am traveling with an ESTA where I stated my current employment situation, where I am staying. I am bringing over my old passport where I never

overstayed and my flight ticket to proof that I am good to get home.

 

I can not really provide any statement of my work, because its not in English. Is that good above or anything else I should bring?

My fiancé arrived last Wednesday (on an ESTA), the same day our NVC status changed to "in transit." He came via Canada as a bridge country since the travel ban is in effect until Nov 8 and had no problems (immigration in Toronto). He had a copy of NOA1 and NOA2 and an invitation letter from me (with his Alien Reg # on it) as well as various other pieces of our petition. He is not currently employed (had a contract end and figured no point in renewing when he was coming to visit here, going home for Christmas + medical and interview, and then will be back here early next year we hope). 

They didn't ask him much of anything at all and didn't look at anything. Didn't ask about ties to home. He's here for 6.5 weeks.

 

Hope your attorney has performed better on other aspects of this.

No, you will not ruin your K1 process or get banned for 5 years simply for trying to visit.  As with every visitor to the US, whether with K1 pending or not, there is a risk that you may get turned away by CBP.  But even if that happens, it will not impact your K1 process, unless you do something outrageous like lying to the CBP officer.

I am guessing you travelled by now. I hope everything went fine. 

As of for me: I travelled during my K1 process as well and didn't get into any trouble. CBP officer even said "Ooooh, congrats!" after I told him that I am visiting my fiancé.

Oh yeah I did, was last year November. The CBP officer didn’t even ask for anything beside the K-1 Visa. Everything went smooth :). 
 

But always say the truth and don’t lie when it comes to stuff like that at the border. Thanks for everybody helping ♥️
