Permanent resident filing for spouse (split)

Hi all, hope all you are well and the process is going smoothly.

 

I posted on here earlier this year regarding my SB1 process. I have now completed the process and currently in the USA awaiting mine and my daughters greencard. My husband is here with us on an ESTA to settle us in and will return to the UK. He will travel back and forth on his ESTA whilst we go through filing for his greencard via i-130.

 

We have been given the timescales of 18 months to go through the entire process. I would like to hear from anyone who is a greencard holder and has filed for their spouse.

 

1) How long was the process from start to finish

2) how did you manage the travel back and forth i.e. to demonstrate your spouse isn't using ESTA to live in the USA. In addition in relation the the proclamation and the 14 days quarantine for UK, how did you navigate that

3) any other tips

 

Would be interested in anyone who can share their experience in general. I would like to know what is ahead of me as I navigate life in the US with our 2 year old,  without my husband :(

1 Proclamation excludes spouse of LPR as one of the exemptions https://travel.state.gov/content/travel/en/us-visas/visa-information-resources/covid-19-travel-restrictions-and-exceptions.html

2 there is no required quarantine for entering the uk from the us (Amber list), assuming your spouse is vaccinated https://www.gov.uk/guidance/red-amber-and-green-list-rules-for-entering-england#amber-list-rules

Thank you for the response. Does the spouse have to travel with the LPR for the exemption to apply? We travelled together on initial entry so no issues however my husband will be travelling on his own on future visits

No, he just needs to take proof of the relationship. He should not check in online before but check in at the airport with the proof of relationship.  From the website of the us embassy in the uk:

 

If you travel, please follow the steps below:

  • Do not attempt to check in for your flight online if you have an ESTA registration.
  • Arrive early for your flight.
  • Carry as many original documents as you have available that you believe demonstrate why you have been excepted from a travel restriction, such as a Permanent Resident Card (commonly known as a Green Card), a marriage certificate, or a birth certificate. We are unable to provide guidance about your documents or whether copies will be considered sufficient as such questions are a matter for CBP when you travel.
  • You may also wish to carry a printed copy of the Presidential Proclamation itself.
  • Your status will be reviewed in consultation with U.S. Customs and Border Protection (CBP) officials. Please note that smaller airports may not have CBP officials on site.
