Hi VJ family, my removal of condition is almost here and I’m preparing towards it. However, I will like to solicit with you all to advise me on documents that should be provided. Though, I read some requirements online but nothing beats general contributions from those who went through the same process and experience it first hand. My wife owns the house we live in so we do not have shared utility bills or mortgage. Also we don’t have shared liabilities or copay on anything. However, I pay the utility bills but the bill itself doesn’t reflect both our names. Please your contributions will be greatly appreciated. Thank you.

FWIW, this is what we sent for my wife's case:

 

Apartment lease with both our names & signatures
Joint bank checking acct statements since wife's arrival in June 2017.
Deed for new home with both our names
Mortgage Lender Letter with both our names.
Credit Cards showing both on joint account with same card number.
Amazon delivery label showing both names and our current address.
Wife's Military Dependent ID card showing me as the sponsor.
Tricare Eligibility Letter showing both of us together.
Military pay statement showing wife as my benefic.
Texas Health Care Directives appointing each other as sole health care proxy(Advanced Directives)
Our Texas driver's licenses with same address for both of us
2018 Joint Tax ReturnTax Returns 
Pictures of us on special occasions here in the US.
Car Insurance Cards showing both of us as insured drivers for our car
Boarding Passes for Las Vegas Valentine Day Trip 2019
Utility application showing both our names for our current address

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

The fact that both of your names are not on the same bill is not totally uncommon.

If they refer to a shared asset or expense you will be fine, e.g. if YOU pay one utility at your house, and you spouse owns the place, and pays a different fet of utility bills at the same address, then you are still covered. They will understand that.

 

And whenever you feel uncomfortable, include a short, clear statement explaining the situation.

 

Don't sweat it too much, they can add two and two, with a little help from you.

Why this for the profile pic?  Often in movies and on TV when they show Hawaii they show this beach/view. So, instead of doing Kauai or some other locale, we decided to do here, so that whenever some show shows Hawaii and this view, we will see where we were married.

You give USCIS far too much credit. They would struggle to count past ten without taking off their socks

 

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

I AM JACK'S COMPLETE LACK OF SURPRISE

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

There are several things that you can do to show that you live there:

  1. Your driver's license should reflect the address where you live. Same for your spouse.
  2. If the utility bills do not reflect your name, your wife can create an online account and add your name as an authorized user. You can print that page that shows your name. You can also add your payment method. Hopefully, this is your checking account or ideally a joint checking account. 
  3. You two should have a joint checking account, and use it to pay for joint responsibilities - like utilities.
  4. If your wife has homeowner's insurance, she should list you on it.
  5. You can also sign up for USPS informed delivery and show that you receive mail at that address. For AOS, my spouse and I both signed up for USPS Informed Delivery and showed that we had unrestricted access to each other's email. (You can see images of each other's mail.)
  6. Health care directive or power of attorney. You can authorize each other to make health care decisions for each other in the event that either one of you is not able to. USCIS takes this document very seriously.

Of note: your evidence starts since the date of your marriage. That is very important. USCIS wants to see evidence since the date of your marriage.

06-15-2021 - Case was updated to show fingerprints were taken. 

05-26-2021 - Received NOA/extension letter. Notice date and postmarked 05-20-2021.

05-23-2021 - Received text message with Receipt #. YSC Potomac Center.

05-21-2021 - Checks cashed (processing on joint checking account)

05-07-2021 - I-751 received in Arizona.

 

Marriage-based AOS - Concurrent filing.

05-07-2019 - AOS Approved. Resident since date 05/07/2019.

05-06-2019 - AOS Interview

04-23-2018 - "Case is ready to be scheduled for an interview"

03-16-2018 - Priority Date.
