I signed it wrong

Hey guys, hope someone can help. I sent out the form I 751 to remove my wife conditional green card and after I sent it 6 weeks ago I realized that I signed part 7 instead of her and she signed part 8 instead of me because I thought I was the petitioner but it was her. What should I do?

I think it is too late to do anything until they return the rejected package or an RFE  back to you.

No they haven’t but its been 6 weeks already and nothing

Option - You could try to stop the payment, then resubmit a new package......but only after confirmation that the payment was stopped.

Option - Wait for either the rejection or RFE, then resubmit.

Personally, I would wait.

 

 the sad thing is, it’s taking way too long. They haven’t processed the payment yet and I dont have my package back yet and it has been 6 weeks

We filed my wife's I-751 package in late March 2019.  We had the extension letter in hand in 7 days from filing........It seems it takes 2 or 3 months now.  It is very sad.  

Did you pay the $680 by check, CC, or money order?

Yeah, I did by check and I can’t do anything until I get my package back, its no fair

When does the card expire? 

 

But yes you can do something, you can always 'do something' its just a matter of figuring out what it is you should do. So the card expiration date matters. Currently there is a backlog at the lockbox in getting NOAs sent out. Everything you mail to them though is logged and dated so if they get your package March 1 your NOA will be based on that date even if they dont mail it to you (or cash your check) until April or May. Regardless of the date on the NOA, IF ROC WAS FILED IN A TIMELY FASHION (ie in the 90 day window before the card expires) then and only then will the NOA serve as an auto extension. So you MUST get a proper package filed with them before the card expires (note that means mailed/delivered to them before the date of expiration- you may have to wait for the NOA but once it comes it will reflect the correct date they got the package). 

 

Your choices are- stop payment on the check and send a new package properly completed with new payment included. -OR- wait for the package to come back to you and send a new one then (but it can take weeks if not longer for the package to be rejected). USCIS has a complex system for rejections. It needs to be 'signed off on' by various people before the rejection it to ensure that the rejection is legitimate.

Ohh okay it makes sense. I still have time her green card expire on April and it has been 6 weeks since I sent the package I dont know if is smart to send another package or wait because we both signed the form but I signed where she was supposed to sign and she signed where I was supposed to sign

Well then keep an eye on your bank account. If the check is not cashed in the week prior to the card expiring then stop payment on it and send in another package using a delivery method ensuring it will get there prior to the card expiring. Check your calendar for what date this should be accounting for unexpected mail delays/weekends/holidays/etc. 

 

Im inclined to believe it will be rejected but you never know. The lockbox does general processing when they accept it. That means a quick look over that all the boxes are checked and its signed/dated properly /everything required is included in the initial submission. USCIS has many policies to prevent people from doing what we call 'holding a place in line' (meaning sending in incomplete paperwork to secure an earlier NOA date). They may not realize the signatures are wrong (because there is text/writing in the fields) and if so you would get an RFE later for it. The whole point of the lockbox doing such pre-processing is to avoid such RFE issues/placeholding. So if the system works properly it will be rejected.

Thanks for you help. I just want the package back or my money taken out of my account otherwise i got my hands tied.  It’s unreal that you have to wait over 6 weeks to get answer or to fix an error in the form

Your waiting has just begun.  We filed my wife's I-751 package in March 2019.  We have been waiting for an interview since May 2019.......yes, I said 2019.  Hopefully, yours will be faster.

Wow what status did you have before did she enter on CR1 or K1? Did you already have an interview before?

CR-1......no USCIS interview previously.....so we wait...LOL
