Applying for AOS without 2020 Tax Return Transcript

My wife was a student in university in the years 2017, 2018, 2019.

She was a dependent for the years 2017 and 2018, however, for 2019 she did her taxes with wages from a part time job (under 5k income). My wife started working in January 2020 and has an income over 60k.

 

For the I-944 and I-864, based on my understanding we will have to submit the 2019 Tax return transcript since that is the most recent one we have. We will also be adding all the paystubs from January 2020 till now which show her income is above the poverty guideline. 

 

The reason why I can't wait for the 2020 tax return transcripts is that me and my wife have to paper file our taxes, I will also need to apply for an ITIN number and I believe this process will take months. 

 

What I want to know is that will the AOS application be rejected and will we lose our fees or we will get a potential RFE? I do not mind getting an RFE later on because we will be filing our taxes soon and have the return transcript ready.

Actually, I figured that we can file the 2020 taxes now and get the 1040 which we can send with the I-864 as well as I-944. The only issue now is that the I-944 requires a tax return transcript which will take months to receive because we are paper filing, but we will write an explaination stating that we will bring it to the interview. So I hope this won't cause rejection of the AOS package.

Current income is KING. Include recent paystubs and a letter from employer (if possible).

Just don't file too early: https://www.irs.gov/newsroom/2021-tax-filing-season-begins-feb-12-irs-outlines-steps-to-speed-refunds-during-pandemic "The Internal Revenue Service announced that the nation's tax season will start on Friday, February 12, 2021, when the tax agency will begin accepting and processing 2020 tax year returns."

Indeed 2020 paystubs with a letter of explanation plus her 2020 W2. Hopefully she already received it, that's a good way of showing she is currently making well above the poverty line 

01/08/2018: Priority Date

01/19/2018: Checks cashed

01/22/2018: 3 NOA's received in Mail (I-130, I-485 and I-765)

02/09/201: Received Biometrics Appointment Letter scheduled for 02/22

02/10/2018: Email notification of RFIE :(

02/12/2018: Early walk-in for Biometrics, successful

02/16/2018: RFIE received for birth certificate and translation, sent back the same day

02/20/2018: RFIE response delivered, sent via Fedex

02/23/2018: Case status updated to RFIE response received

03/05/2018: Courtesy letter for I-693, medical exam received, letter dated Feb 28th

03/08/2018: AP application delivered by Fedex

03/19/2018: NOA for AP received in the mailbox

05/03/2018: AP ONLY approved (Approved in 56 days)

05/11/2018: AP received in Mail

05/21/2018: Email received,EAD card in production (Day 133)

05/22/2018: Interview scheduled

05/25/2018: EAD approval letter received in Mail

05/29/2018: EAD card and letter for interview (Jun.26th) both received in Mail, Woot woot :)

06/26/2018: Interview completed, now waiting for the magical email/letter...

10/30/2018: Went to Infopass, officer has not made a decision yet, an email was sent to him tell him I came to inquire

03/26/2019: Moved so updated our address online with USCIS

04/16/2019: I-130 petition approved

04/20/2019: approval notice received in the mail

04/22/2019: received notification of RFE for AOS I-485

06/01/2019: RFE finally received after being lost in the mail, asking for a new medical exam

06/06/2019: Response to RFE sent, received the next day 06/07/2019

06/17/2019: Received notification of another RFE, 3rd time will be the charm hopefully

06/22/2019: RFE received for new medical

07/02/2019: Went to doctor for new medical

07/11/2019: I-485 approved without new medical exam

07/18/2019: Green Card received in mail

You’re not. At most you’ll get a RFE, but not a rejection. A rejection happens usually when one of the main documents is missing, such as the birth certificate. I think your idea of sending W2s, an employment letter and paystubs would have you covered. If you can, send 6 months of paystubs. Also, look for online templates of employment letters to USCIS. That’s how we did mine

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!
