Hello Everyone,

 

It's been awhile since I have been on here.  My wife and I have finally reconnected in USA, our Visa Journey was long but she is now in the process of receiving her Green Card using the IR1/CR1 I-130 process.  My question is, now that she is in the USA what is next?  Immigration stated that it may take up to 6 months to get the physical green card.  I know that 90 days before that green card expires, we will need to apply for permanent residency.  I thought I read that there was another stipulation that 90 days before our 2 year wedding anniversary we will need to do something as well but I can't seem to find that anymore.  With the goal being permanent residency and not citizenship, what should we be doing next to ensure that the process goes smoothly?  Any advice or guidance is greatly appreciated!

Hello,

 

I assume your wife entered the US on her CR1 visa?

 

If so, then you just wait for her greencard and SSN card.  Officially it takes up to 120 days for USCIS to print and mail the card to you.  But it has taken some here longer to get their cards.

 

The above is assuming you have paid the $220 immigration fee after your wife got the CR1 visa from the embassy.

 

At 90 days or less before her 2 yr conditional greencard expires, you need to submit for removal of conditions, ROC.

 

There is nothing related to 90 days before your 2nd wedding anniversary.

Ok awesome!  She got her CR1 visa from the embassy and paid the $220 after her interview.  So now we are just waiting for the green card and 90 days before it expires we need to submit for removal of conditions.  Thank you for the information!  I might have just read so many different things that I got stuff mixed up.

The green card you receive depends in how long your married. You will receive a 2 year conditional green card if you and your spouse has been married less than two years when she entered the USA with CR1 visa. You will receive a 10 year permanent green card if you and your spouse has been married two years or more when the green card is issued (the day enter into USA). 

 

USCIS sometimes make mistakes when issuing green cards so if you have been married two years or more when green card was issued make sure you get the 10 year card.

If you have been married less than 2 years then you will get a conditional green card, check the date issued (date entered the USA on visa), and date expires 2 years later USCIS sometimes makes mistakes. You can file an I-90 form to fix error on green cards (Names spelling, dates, type issued)

 

If you are issued a conditional green card you will need to file to remove the conditions on the green card within 90 days before it expires  by filing an i751 form with evidence.

 

How long you have been married is a factor in which type of green card is issued only.

 

Everything else depends on the date your green card was issued, like naturalization eligibility (3 years or 5 years).
