My wife's 10 year green card expires 3/2021 ..when should she file the N-400? We wanted to file before the fees change..I read somewhere the fees will increase after December 23rd.

Thanks,

Michael

She can file anytime she wants, assuming she meets the physical presence and continuous residence requirements, if she has had her green card that long. The basic time requirements are 3 years from date of initial green card if married to a US citizen the entire time and 5 years otherwise.

If your wife is already a 10 years GC holder and will expired in next few months then she can apply anytime now. Assuming she  got 2 years conditional GC then 10 years GC She's already pass the 3 years and 5 years requirements i assume because of the 10 years GC expiration date. But your profile says you are in AOS stage unless you didn't update it.

The effective date for the citizenship test was filing before today.

I couldn't find based on which time zone. My wife filed N-400 yesterday at 9:26PM PST; we live in California. The email confirmation and USCIS online account says file date of 12/01 12:26AM. She then uploaded for "Unsolicited documents" a PDF titled "Correct File Date is 11-30-2020" and explaining that based on our local time it was still filed before Dec. 1. So now, we still have doubts on which citizenship test version she would have to take.

The online filing time is glitchy anyway.. remember hypnos’s story of initially being denied for submitting too early for naturalizing because of the time stamp on the file even though he didn’t? Not sure how to “prove” anything. Did she get a prompt email receipt perhaps that is time-stamped before midnight Pacific time?

The email confirmation from ELISdonotreply@uscis.dhs.gov came very quick. It came at 9:27PM, but the content of the email obviously used EST time zone: "Transaction Date: Dec 01, 2020 12:26:50 AM" The pending CC charge says the merchant (USCIS ELIS N400) is in Washington DC.

Also is it the fees change or the citizenship test change you are thinking of? I thought the fee change was on hold, has that changed? The effective date for the citizenship test was filing before today.

Ok now I'm really confused, are you saying she should have filed before today?

Important Updates to the Naturalization Test

USCIS has revised the civics portion of the naturalization test. All applicants for naturalization with a filing date on or after Dec. 1, 2020, will be required to take the 2020 version of the civics test. For more information, visit The 2020 Version of the Civics Test page. Applicants for naturalization with a filing date before Dec. 1, 2020, are required to take the 2008 version of the civics test.

https://www.uscis.gov/citizenship/2020test

What should I expect at my naturalization interview if I am taking the 2020 version of the civics test?
With the 2020 version of the civics test, the USCIS officer will ask you to answer 20 out of the 128 civics test questions. You must answer at least 12 questions correctly to pass the 2020 version of the civics test. All questions on the test are asked orally.

There are no changes to the English portion of the naturalization civics test. You must demonstrate an understanding of the English language, including the ability to read, write, and speak basic English.

  • Speaking: A USCIS officer will determine your ability to speak and understand English during your eligibility interview on Form N-400, Application for Naturalization.
  • Reading: You must read out loud one out of three sentences correctly to demonstrate an ability to read in English.
  • Writing: You must write one out of three sentences correctly to demonstrate an ability to write in English.

But OP was talking about a fee increase on 23 December??? So I’m unclear what he is trying to beat. I personally haven’t seen anything about an imminent fee increase, not sure if I missed a new development.

Let her take the new test. I mean, has she crammed all the answers from the previous version? That's cheating 🤣🤣

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.
