Hey everyone,

I have a quick question. My father is the joint sponsor for my wife(the beneficiary). He files a  joint tax return with my mother so I am filing a i-864a for her and an i-864 for him.  My question is do I have to include my mother's salary in the "current income" section Part 3.7 on the I-864a. I don't want to put her current salary because she doesn't get pay slips and it would take a long time to try to get some proof of her current income. 

 

My father makes enough to sponsor my wife (the beneficiary) so we don't need my mother's current income.

If your father income covers financial support, you don't need your mom i-864a. It is always a common mistake filing i-864a when you file tax jointly.

Yes, we've been advising people to provide an I-864a from a joint filing spouse, for a long time.  We do this to avoid the delay that occurs when Consular Officers ask for it.  It is technically not required, but in practice, it is OFTEN required.  Anything a consular officer asks for, suddenly becomes "required".

 

The advice is a "best practice", not a firm requirement. (Until it is asked for....)

Sounds like Mom is Self Employed.  If so, her current income is documented on the 2019 tax return.  However, you can enter ZERO as the amount of her income YOU ARE USING....
