Hey everyone,

Bit confused. 

I moved back to the USA a few months ago and am currently living with my parents. I am aware since I worked abroad my income can't count towards sponsoring my wife. 

1. What should I write for my income even though it was all from overseas? I filed my taxes but paid nothing since I didn't make over the threshold. It's still asking for my last 3 years salary. 

2. What form should my mom fill out as she is the one who will be sponsoring my wife. Since we live in the same house do we do the I864a? Or should she just fill out the normal I864. Also since she files jointly with my father will he have to fill out anything as well?

I’ll defer to someone else but this may be needed to answer you correctly- do your parents claim you as a dependent on their taxes?

well I did find a job 2 months ago so I do have a constant salary here now. However for the past 3 years all my money was made abroad. So I wasn't sure if I write down how much money I made, even though I know it can't count or just write 0.

Ok so for current income you will enter whatever your current income is (part 6). Then on Part 6 starting at #23 you are going to have to check the appropriate boxes. Sounds like you havent filed the last 3 years due to being under the threshold. Check off boxes accordingly and you need to attach a statement saying you didnt file because you didnt earn enough. 

 

Now for the other question you asked you have a few options. You live with your parents so they can be considered household members. For that you fill out the 864 and include them as household members and they would each do the 864a. This would make the overall household size 4- mom,dad,you+ immigrant. This is #7  in part 5.   OR you can do the 864 for you+immigrant with no additional household members- you would not qualify so mom or dad would be a co sponsor. They would fill out an 864 as well and their household size on it is 3- mom,dad+immigrant. (this is providing they have no other children or dependents). One parent would be the primary on the 864 and the other would attach an 864a to it so both their incomes would be counted towards household size 3.
