2019 Tax Transcript

What happens if you are not able to get the 2019 tax transcript? I am unable to get one online because I recently got a name change and the system is having trouble establishing my identity. I also mailed my tax return in February 2020 because for all of 2019, I worked aborad and was not able to e-file. I am sure the IRS has yet to process my 2019 paper tax return.

 

Because my income for 2019 is all foreign, will this be an issue if I do not have a 2019 tax transcript? Can I use my foreign paystubs/income letter, and my tax return? Will a letter from my employer documenting my current employment and current paystubs be a substitute for this?  I was able to get my 2018 and 2017 tax transcripts through the mail earlier this year, but that income does not reflect my current income which now exceeds the minimum income requirement. 

 

Just trying to get my documents together for NVC stage ahead of time since everything has signficantly slowed down.

You can submit a full copy of the tax return. This means the 1040 + all supporting forms.

Evidence of foreign income is not required for the tax return (although should be retained in event of an audit).

 

Will your income continue from the same source upon returning to the US? If so, list it on the I-864 + provide evidence of it (i.e. paystubs and employment letter).

If not, our eligible income for I-864 purposes is $0.

Edit: Or are you back in the US already and working in the US? If so, it'll count fine so just include the paystubs + employment letter. That is your current income.

Thank you. No, my foreign income did not continue when I moved back to the US. My income from 2017 and 2018 also did not meet the income requirements because I was in graduate school, but my current income exceeds it so hoping that will be enough to sponsor my husband! I do not have any friends or family to co-sponsor him.

Correct, and then all this discussion of foreign income in the past is for nothing as you will likely enter $0 for all three tax years in the tax return section.  The number is the number from the "Total Income" line.  When you take the foreign income exclusion, that number is usually ZERO unless you are earning more than 100k a year (USD equivalent) abroad.
