Expedite request explanation

Hello all,

 

I have submitted an expedite request for my wife, who is currently residing in an area where missiles are landing in Civilian areas, hitting hospitals and residential buildings. Submitted all of the evidence with news articles and pictures, all from reliable sources (reuters, bbc, etc).

They came back and replied with the following:

"We received your response to our request for evidence of your emergent situation. However, we cannot grant your request for an expedited review of your case Our system indicates that the required background investigation for your pending case is still open. We cannot move forward with your case until the background investigation is completed. These background checks are required to be completed on all applicants who apply for the immigration benefit you are seeking. We will make every effort to make a decision on this case as soon as the background checks are complete. We apologize for any inconvenience."

 

Wouldn't the expedite request speed up these checks? It does not make sense to me. What exactly is the point of the expedite request if the process cannot be expedited...

 

If anyone can help or give feedback. That would be appreciated.

An expedite request does NOT mean they will speed up checks. Where did you here that from?

 

A request is simply that... you are simply asking if your case can be expedited. Nothing happens with speeding up your case  until after the expedite is approved. Not before or during.

 

And they are correct, they can't move forward with your case until background checks are done. Period. Background checks is one of the most important parts of the process. Also, if there is hold ups on the background checks from your very own country, then the blame is your (or the beneficiary's) country. 

 

One last thing, expedites are usually based on the hardship or emergency of the US citizen, not the beneficiary.

Timeline

Immigration authorities have to rely on other agencies within the US as well as other agencies in foreign countries to complete required background checks.  Since background checks can not waived, any internal expedite process is dependent on those outside agencies completing their tasks.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Timeline

Our case was expedited for the exact same reason, but not before background check was complete. Those checks are mandatory and NOT in the hand of USCIS. OP please fill out your timeline and people from same region might be able to share an experience.
