My Parents Timeline

File I130 and I485 Concurrently Jan 9th 2020

Biometrics   Feb 6th

RFE for passport Photos April 23

Email Notifying I130 Approval May 4th

RFE May 6th for explanation on why they answered yes to (Have they ever violated non immigrant status)

They overstayed their holiday visa

Also they want explanation on why they answered yes to working without authorization. The thing is they never worked and they answered no on the I485 yes no check list

 

waiting for my lawyer response. Any insights from anyone

Did this lawyer file the initial application? Sounds like they made some pretty basic mistakes.

What explanation/reason (if any) was provided for violating status? What was listed as their current status?

If none was provided, the RFE makes sense as they don't know if it is something that is a bar for AOS purposes or not (or likely what code to list in their system).

 

I would suggest just answering the RFE's questions directly asked - they overstayed their legal status but did not perform any work.

There's no such thing as a holiday visa for the US.

Not the first time that's been used and it shouldn't be a problem. But I would just not that Applicant for Adjustment is not a legal status. They're looking for like B-2 (if tourist visa), or "B-2 overstay" if you want to clarify that they overstayed. Either way, not an issue now. I was just curious.

Im pretty sure he is talking about B2 visitor's visa

Probably...that would be my guess as well.

I just point it out as there is no US holiday visa. There are various holiday visas for other countries, including "working holiday" visas that permit employment.

My Parents Green Card got approved

They are in their 50s, they are going to be self employed. They are planning on buying their own health insurance. They are not sure how it works. Any suggestions?

I would suggest to start by looking at their state's exchange. http://healthcare.gov

They would not qualify for Medicare or Medicaid for at least 5 years.
