Divorce after 10yr greencard received

I have tried and tried but it seems I am at the end of my rope. My husband keep saying that he is going to change and his drinking is not a problem... well, it looks it is from my perspective. But this is another story! I want to divorce and I am pretty confident I have all my ducks in a row on this one. My only concern came up when reading the divorce documents.

There is no room on them for the country where the marriage took place. Am I to just cross out the State and put Country instead? We live in Texas. Are there any special rules pertaining to this state or according to this state we are not even married even though we went through the whole INS scenario based on our Romanian marriage license?

Do I need to get married - in Texas - in order to be able to divorce? That would be a joke.. sad one, but still a joke.

Anyone gone through this before?

Any advice would be appreciated.

I'm sorry, I understand how you feel. My ex was never "drunk" he was only "a little tipsy"....every day! :wacko: Admitting that one has a problem is a first step for recovery.

About your divorce process....you may want, and need, to have your Romanian marriage certificate translated by a company/service that specializes in foreign language document translation. (I've seen this done w/ foreign language birth certificates, education diplomas and such. Usually doesn't cost that much either....depending on the language of the original document) On a side note, have you thought about working with an attorney to process the divoce? I'm sure an attorney can advise you best on how to fill out the forms, and how to go about things.

I am sorry to hear your situations. Please be strong. You should go through the divorce process with an attorney's help. Immigration status has nothing to do with divorce. Good thing is, you already have your 10-yr permanent green card, so you don't have to worry about removing conditions, etc. You should get divorced first in order to get married again. There is no such regulation that your next marriage has to take place in Texas. Good Luck.

It took 92 days for I-130 to get approved from the filing date

NVC Process of I-130:

It took 78 days to complete the NVC process

Interview Process at The U.S. Embassy

Interview took 223 days from the I-130 filing date. Immigrant Visa was issued right after the interview

I am so sorry to hear you have problems, follow what Paula&Minya said, I am sure that the divorce can be done from the States with a lawyer, no need to get married again once you are married and your marriage license recognized.

No, you can divorce in Texas no matter where you were married. Talk to a family lawyer to make sure what to do about the paperwork.

No, you can divorce in Texas no matter where you were married. Talk to a family lawyer to make sure what to do about the paperwork.

Yes, I agree. Plus there is no rule that your next marriage must take place in TX, since your divorce would take place in TX.

At this point getting divorce will have no effect on your immigration status. The only thing that will change is that you wont be elgible for citizenship in 3 years. Instead it will be 5 years.

I dont know the texas family law but intuitively, it doesnt matter where you got married, as long as you were

legally married. The legality of your marriage is not a question because I guess you had proved it already when

you got immigrated. The only other question is the domicile - if you have been living in texas, have a job in

texas, have assets in texas etc you are domicile in Texas and hence in the jurisdiction of Texas and so Texas

has the jurisdiction to dissolve your marriage also. Give a quick call to an attorney and discuss this. (be wise when

you choose an attorney-you dont want to be their ATM machine because you will charge you for even going to

'loo' on your time :) )
