Hey guys, i have a few questions in reference to the i864 requirements for the IR1 visa, im the petitioner and im petitioning for my spouse.

 

Questions

1.       If I submit a tax return transcript does a w2 form need to be included or is that only necessary if you submit a complete tax return?

2.       Do I have to submit my last 3 years tax return transcripts or only my most recent? I have been unemployed for over a year and half.

3.       How much does a Co-sponsor have to make in order to sponsor an immigrant?

1. best to include transcripts, as that is what they prefer, and saves you a lot of extra pages

2. I believe the actual requirement is just the current tax transcripts as they want to know current income, I included previous 3 years of transcripts just to give them a better overall picture.

3. You will have to look at the tables on the current I864 form, I think I have a link here...  https://www.uscis.gov/i-864p

 

Note: if you have been unemployed for the past year to year and a half, how are you going to prove current income? That is a definite requirement. In your case I would begin looking for a joint sponsor.

Transcript is a all in one thing. nothing else should need to be included if you send transcripts. That is the benefit of using transcripts, saves the IO from looking thru multible pages of a 1040, a schedule C, W-2's, and who knows what else in the full tax filing. My taxes are about 10 pages after I print them out for my records, where the same transcript is only 2 pages and has all the relevant information.

 

Joint sponsor or co-sponsor is the same thing in this situation, so you should be covered, but with transcripts no w-2 is required.

Definitely the transcript is the best way to go. No W2s or 1099s or anything else needed.

 

My 2016 return was almost 200 pages.  The transcript was like 4 pages.

 

If you were not required to file a tax return for a year write a letter explaining that and upload it for that tax year.

 

For a I-130 it is a joint sponsor. If the joint sponsor is married their spouse will need to do an I-864a.

June 15, 2018  I-130 DCF Appointment in Juarez  -  June 18, 2018  Approval E-Mail

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Thank you so much for the info. I have a question. I am a US citizen living abroad, married in 2017, working on my spouses IR1 visa. I dont have any tax transcripts to be included with my i864, as my wife doesn't have a social security number nor an ITIN number, so i haven't been able to file taxes jointly yet. Would my joint sponsors i864 and his/her tax transcripts alone suffice if it exceeds the minimum requirements?
