Question about tax joining

Hello everyone, I have to submit the I-751 for removal of conditions to get 10 years permanent card. I read many articles and know that joining tax statements is a very important evidence. However, we are full time students at University with any income,  and my parent-in-law support everything for us( we live at their house as well). Do I need to explain our situation in our cover letter ? Please excuse for my English. Thanks.

You can still file taxes even if you have no income. You can backfile for a few years also, but that might not help now, you would have to ask a CPA. You can file this year still and have a transcript a few days later. I say always file every year, even with no income. Being full time students you may be eligible for programs that actually get you money back.

 

As a note, find a real CPA, try to avoid h&r block, or liberty tax, etc. They are a cookie cutter when it comes to taxes. Shouldn't be too expensive to do, and benefits of having transcripts is good

Even if you were students, why would you not file taxes? In fact, because your income is so low, you might even get money back from the IRS.

 

Open up the free version of Turbo Tax and see what it says. 

 

I always filed my taxes when I was a student (I did work 15 hours a week on campus) and got decent amount of money back every year. Just try!!

Joint tax returns can be very important documents when you file for your I-751, but they are not mandatory.  Based upon your question, here is what I suggest:

 

1.  Write a cover letter and explain that both you and your spouse are full-time students, and have no income.  Therefore, neither of you are required to file tax returns at this point.

 

2.  You will need to get an affidavit (look up the rules for this) from your parents-in-law stating that the two of you live with them, and, that at this point, they take care of the utilities, so you have none in your names.

 

3.  Be sure to send evidence that you live at the same address (you and your spouse).  This could be copies of driver's licenses, letters from your university showing the same address, student loan paperwork, etc.
