Form I-130, Part 5 - Please help!

Hi All,


A little bit of background:


- I am the USC petitioner working to fill out the AOS packet for my wife (from South Korea)

- She entered the U.S. legally via K1

- But we were married a few days after her K1 expired due to some unforeseen circumstances

-Thus, we are stuck filling out form I-130 


I am currently filling out I-130 and I have a question about Part 5 Item 1, which reads:


"Have you EVER previously filed a petition for this beneficiary or any other alien?"


When they say "petition" here, do they mean exclusively an AOS petition, or would a K1 visa also count? As stated above, I did petition for my wife to come on a K1, but I am not sure if that is what they want to know here. It seems more like they are asking this in order to catch people who have tried to adjust status multiple times (fraud), but I just want to make sure.


AOS veterans, what should I do here?

Yes - an previous I-129F is a petition. Geez

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath
