Hi all,

A little backstory, I came to the US as a J-1 and stupidly got married at the end of my year to my then boyfriend. Long story short it didnt work out between us and I never ended up filing AOS packet with him, therefore ending up "out of status" for over 2 years. Met my now husband, finalized divorce, got married again and now we have our interview coming up.

My question is are they going to bring up my first marriage at the interview? And will I have to bring evidence that that marriage was bona fide too even tho I never filed for a green card?

It may or may not come up. It would not be unheard of for them to look at a prior marriage.

The fact that no attempt was made to become legal with that marriage does not jump out as a negative or positive to me.

Good luck.

They will not ask for bonafides of your previous marriage. It is actually very helpful to your current case that your ex is a US citizen and you did not file for AOS. That alone shows you did not enter into the marriage for immigration benefits. I'm assuming your ex is a US citizen :)

Yes he's a US citizen. I'm hoping they see it that way too lol thank you for the help!

I had same experience they brought it up even though I didn’t file with her b4 we separated. Just know few things like his address, what year did you move in with him n what year you moved out, how long it lasted.etc that was exactly what they asked me n I couldn’t remember cuz they marriage did last more than a year🤷‍♂️
