I have a question on applying for a Fioncee Visa

Hi everyone,

I met my girlfriend while she was visiting from Poland on a 6 month visitors visa. We were together for 3 months of this time. We have since been communicating via the internet for the past 5 months. We have been together for a total of 8 months. I am planning to visit her from April 14th until June 14th (2 months) and propose to her on the trip. I will come home and file for a fiancée visa to marry here in the US. My girlfriends sister is married and has lived here for the past 6 years. I know that the sister is applying for some type of sponsorship visa to bring her sister here permanently. My question is this: Will this present a problem for a Fioncee Visa? should I tell her to remove the application now, before I leave? should I wait until I return? We have plenty of proof that our relationship is for love rather than immigration. I have saved every a-mail, letter, and picture that we have together. Can you give a little advice on the matter. Do you think that since she is currently applying for a visa it will present a problem for a fioncee visa?

10/30/06- Interview scheduled for November 22nd!!!

11/30/06- Visa in hand, via DHL!!!!

12/05/06- Ania and I arrive together in the USA

02/11/07- Ania applied for Social Security Card

02/17/07- Ania and I were MARRIED!!!!!!

07/24/07- Social Security Card in hand- after some minor issues and a little procrastination :)

10/14/07- I-485, I-765, and permission to travel mailed to USCIS

10/17/07- Received NOA1

12/17/07- I-485 shipped to California Service Center for faster service

12/17/07- I-765 approved new card should be mailed within 30 days, Advanced parole approved

02/28/08- AOS APPROVED!!!! PERMANENT RESIDENT CARD RECEIVED!!!!! (card received couple weeks after approval)

Hello Andy,

I think that one person can't be sponsored by two people at the time. You need to take a look at processing times and evaluate which way will be faster for you.

I am from Poland and my service center was in Vermont. I received my visa after 4 months. My friend, whose service center was in California waited 8 months.

I don't think it matters for you how she comes here. If her sister's sponsorhip is moving fast and you know when she might get here, why not continue this.

I'm guessing that the Visa your fiance's sister applied for is going to take many many years to get. The fiance visa might be a lot quicker, so you probably need to look into finding out how to cancel the application her sister has made, and start over with the fiance visa.

All nonsense and a lot of guessing.

There is no conflict with a family member having filed a petition (that won't be current for many many years yet).

She will need to disclose the petition on her visa application.

You might want to investigate getting married in Polcand and filing from there; I don't know if they will still do this for non-resident US citizens, but you can read the DCF Guide here and contact the Consulate in Warsaw if you are interested.

My fianceé actually found out that she was in the final stages of winning the visa lottery in Romania right before I was going to send the I-129F in...

We talked about it for about 5 or 10 minutes. We decided to go with the K1 Visa because we knew that we would have a 90-some% chance of getting it. Her notice for the Visa lottery wasn't a sure thing, and besides, it would've probably taken longer.

I would research more into which type of sponsorship-visa it is, and whether or not she would actually be able to stay permanantly.

November 2004--I'm on vacation in Italy and met Gabriela at a pizzeria in Venice...it was love at first sight!

2 Weeks Later 2004--changed my intinerary to go back to Venice and see this Romanian girl that I couldn't stop thinking about.

August 30--My sweetie's Birthday! I love you, doll!!!

September 9, 2005--I-129F sent to NSC.

September 15, 2005--NOA1!

October 24, 2005--NOA2!!

November 07, 2005--NVC letter received!!!

Early December 2005--K1 packet gets to the Consulate in Naples but somehow they forgot about notifying us in any way, and apparently replying to emails is just waaaay too strenuous for them...

January 11, 2006--After numerous failed attempts to contact them, Naples Consulate emails packet3.

January 2006--I contact my state senator's office.

March 20, 2006--Gabi has her medical exam in Naples...

March 21, 2006--Gabi has her interview...K1 VISA ISSUED!!!!!

April 18, 2006--I will fly to Europe to get my honey...and never, ever let her go!!!

meauxna is absolutely correct. There is lot of incorrect information being given. A sibling visa can take several years (when I checked for my brother or sister in India - it was 16 years wait time!) But you can always file another visa e.g. K1 and get that in 4 to 6 months - just declare that you have been petitioned for a visa before - it will have no bearing on your K1. Smile and Good Luck
