Just changing their name won’t fix it you might have to fix their birth certificate itself. 
 

As I have said have asked for this to be moved to the Philippines section as they have way more knowledge than myself on this. 

So I need to come back to PH to change there last name under my last name... is that what you saying I came here feb 19 2019 and it’s possible to bring them for k2 visa. Coz one year before to processing child

When was your visa issued?  you only have until one year after your visa was issued to get them a k2. 
 

As I said just going to court to change their name may not fix it depending on what their birth certificates say. If they shouldn’t have his name unless you were married then having a birth certificate with him on and then getting his name will indicated that you were married no matter what the truth was. Do you see the issue with that?

The date you came here doesn’t matter it is the date of issue on your visa that matters. January 2019

Per approved i129F you have no children, so what will be the basis of K2?

You have zero chances of getting K-2 visas.  

 

A K-2 can only be issued within 1 year of a K-1 visa.  There is no way for you to get K-2 visas issued by Jan.  8, 2020.  

First, the kids were not listed on the I-129f so you would need to get them added to the petition.  You would have to contact the US Embassy.

 

Two, there are probably no interview slots available before Jan. 8.

 

Your USC husband needs to file separate I-130s for your children.  It will take about a year for them to immigrate to the US.

I’d say just have your husband start a new petition, i130 for each kid. You may have to get a statement from the father of kids that he will have no issues for his kids to immigrate to US.

Ohh it’s okey so my husband his willing to petition them. I’m not rushing or anything I wanna make sure that there coming here. If my husband petitioned them it’s doesn’t matter what my kids last name right of my x bf

Really each kids not only one papers well my oldest she’s 13 now so better her first
