EAD rejection notice and incorrect payment

Hi everyone

 

Today after  4 weeks of waiting after sending AOS package I got rejection notice for I-765 saying that it is missing last 2 pages (6 and 7) and that payment amount is incorrect or hasn't been provided.

Even though I'm 100% sure in that I had pages 6 and 7 of I-765 and that I attached G-1450 for $1225.

This is just so frustrating, this month is stressful. First USCIS came to our apartment with visit and now USCIS says I didn't provide these things.

 

Well now I have a question. The notice says to send once again full I-765 and payment.

Considering that I didn't get any information about the rest of the package (I-485 and I-131) should I send check for the same amount as before $1225? or now it should be separate for EAD?

No fee for the I-765 when you have a pending I-485. Send a copy of the I-485's NOA1 in lieu of payment.

 

Edit: What category did you put on the I-765? You may have used the wrong category, which would have a payment required. i.e. (a)(6) instead of (c)(9)

Thank you for response. No it's c9 in my application. They put it even on the top of rejection notice information.

 

But I didn't get NOA1 and card wasn't charged

Okay, (c)(9) is correct so - assuming the I-485 is accepted - it sounds like an error on their part. Not their first.

 

If the I-485 gets rejected too, then that would explain it as well (since it is a derivative benefit of the I-485).

It might not be a bad idea to call and check. Four weeks without a cashed payment is on the long side of things.

Hi!

 

I called USCIS yesterday and found out that I-485 and the rest of the package was rejected as well. Just as you said. 

Today I got everything in mail. 

All of the forms and even Affidavit of Support are missing pages. I don't know how's that happened. Seems like all my package got blown by wind there at the office and this is all they could collect. It's unbelievable. I mean I could have missed a page in one of the forms, but not in all of them!

 

Anyway..

So now I have to resubmit everything again. The thing is they stapled papers in 4 groups. The first one with I-485 and all provided copies of my passport are all together and there is a paper that says to place this letter on the top of new filing package. I guess it means to put the whole package i got back and make new one with the same content???  This is very confusing. They stapled 3 certified copies of marriage certificate and NOA2 together. does it mean I can't use the same marriage certificates? I mean I have to get 3 more certified copies for the new package and add this part of letter as rejected one?

And also they opened the envelope that I got from civil surgeon. Now I need to go to get new one again?

You can use the same documents in the refiling (since all are still acceptable versions since you filed, AFAIK). Just add in whatever is missing.

 

Not sure on the I-693, sorry.
