K-3 and SS#, work, driver's license??????

I'm wondering, once my wife does get here on a K-3 visa what steps need be done so that she can work, and get a driver's license. I've read about the AOS, but does that mean she can't even get a driver's license until we get that far???? I've read the guide, but I'm still a little gray on what it is going to take to keep my wife here permanently and get her citizenship.

This is whole system of approval and what the spouse can and cannot do is terrible. I feel this whole immigration system needs reform.

We are already married and just want to get on with our life. I'm still waiting for NOA2.

I was able to get my ssn pretty much when i got here, and have just got my driving permit (need practice before I take the test!) but I came on a K1 visa. I have a feeling that you will not be able to apply for a SSN - which is what you need to get a driving license before you have actually adjusted your status on a K3. And she definatly will not be able to work before she has her EAD. But I'm sure that someone who has a little more info will be able to explain things more for you x

K1 visa holders can get an SSN right away but K3 folks need AOS or EAD first. That takes about three months, give or take.

Check with your state on what she will need to get a drivers license. It varies. My wife needs to learn to drive first. :yes: I'm pretty sure that's required in most states.

Greetings!

I entered here using K3 visa and immediately sent EAD along with my AOS application. I got my EAD first and immediatley went to SSA office to get an SS number by showing the EAD card and i also took some documents such as marriage certificate,birth certificate and passport just incase. Then headed to the Secretary of State/ DMV took the test and passed for Drivers learners permit...Along with the above mentioned documents plus mailing address with my husbands name on it. ( proof of mailing). Took the road test,passed and got my licence and at the same time working. Four months after AOS was approved, interviewed and got the card. Went back to SSA office to update SS details ( the removed restrictions).

Someone in another thread as a K-3 was able to get their EAD approved in 1 month... hopefully you'll be so lucky if you wish to file for EAD prior to AOS. The EAD filing prior to AOS lasts for the length of the I-94 (so only 90 days for K-1 but 2 years for K-3). Technically employers are responsible to ensure that all their employees are work authorized. If your wife should come through JFK airport she is able to possibly get a EAD stamp in her passport.

A SSC can not be issued until it can be shown that the person is work authorized. So by showing your K-1 Visa or in your case as a K-3 a EAD/GC.

As someone else stated it depends on your state what the requirements are to get a drivers license. Here is an unofficial site or you can do a search for your local DMV/MVD. http://www.dmv.org/

Because his passport was used as his "proof of birth", he needed to have something else to prove his signature. So he used his French ID card. They also required something that proved that he lives here, and fortunately we had brought our bank statement with both our names on it.

They said that if he didn't have a Social Security number, that he would have had to bring a lot more documentation (but he didn't specify - I think because he didn't know).

Most states require a ssn for a driving license/permit, however, ssn's cannot be issued to a k3 visa holder until they apply for AOS and receive the EAD.
