Hi. Just wanna ask we already have eligibility letter to set appointment for our interview. My problem is i need to get my fiance a cenomar here in the philippines but he is still technically married here in the phil because they processed their divorced in us. His ex wife filed the divorced and she's a us citizen. My question is, do i still need to get my fiance's cenomar? Will they ackowledge the divorced here in the philippines? Will it be a problem in the interview?

Yes it's going to be a BIG PROBLEM his cenomar and his CEMAR  must reflect that he has had a foreign divorce. I just had a buddy of mine go through this not just a week ago and his fiancee received a 221g. His name is @redfeather and his case is like yours I would message him to find out what he did to resolve this issue. I do know it was a big hassle. But I am thinking in order to get that annotation on his cemar he is going to have to go through the courts there in the Philippines. But to be sure contact @redfeather he can tell you more as he just went through it.

Yes you need the CENOMAR.   The embassy will recognize the divorce

Yes a CENOMAR is a required document, if still married in the Phils PSA will issued the CEMAR ... this is fine as long as he has a copy of the divorce decree to present at the interview.

 

There appears to be one CO at the embassy that doesn't have a clue about divorce decrees and the K-1 visa ...  there are two cases I am aware of ... neither reported back on their final result.

Okay troops,

Here is what happened to my gf at her Sept. 12th US Embassy interview.

The CO wanted my gf to show her both a Marriage Certificate and Cenomar that had an annotation on it that stated "with foreign divorce decree".

My gf only had one document which she had gone to get at the PSA the day before on Sept. 11th at the PSA which was her Cenomar and it was annotated "with foreign divorce decree", so the CO gave my gf a 221g and made her go back to the PSA and get a Marriage Certificate annotated "with a foreign divorce decree".

So, the bottom line up front is you may have to get both a Marriage Certificate and a Cenomar annotated with a foreign divorce decree...or you may get a 221g.

My gf got the Marriage Certificate annotated with a foreign divorce decree and mailed it back in using the 2Go courier service that same day on Sept. 12th.

My gf said the Marriage Certificate has more details about where got married and more info about the guy you married, etc.

We are now waiting to get her visa issued from the CEAC website.

I hope this answer might help others that are in this same situation.

What process did you fiancee have to complete to get the PSA documents annotated "with a foreign divorce decree" ?

 

So as of now you do not have ISSUED status on CEAC ?   

 

This is soooooo weird as I know of hundred that have been in the same situation and had zero issue with the interview.     

 

Biggest question I have ; Is it just a certain CO that is raising this issue?     

 

Would really like to have a way to contact the IVU "boss" to get a clarification as to if this is a new policy or a new CO.

My gf had to go to a court hearing in her Province on May 20, 2017 to get her decision and finality, and you have to have the City Hall registry in Manila receive the Exhibit and return this to the Local Civil Registration and they forward it to the PSA and then the PSA annotates "with a foreign divorce decree" on your Marriage Certificate and Cenomar.

We do not have an issued status on our CEAC, but I hope to have issued by the end of Sept.

I do not have you an answer as to whether it is only one CO, or is it several CO that are now requiring these extra documents and extra steps.
