Hello everyone, 

 

I filled for my dad a couple of times for tourist visa, he got denied both. In his criminal record, I put no. However, I recently found out that he was put in jail for a year when he was 18 for protesting against the communist. 

 

Now, I applied for him the IR5 visa and waiting for it to be approved. Please advice me how to fix this mistake. I don't want him to be ban from the US over this. 

 

I am also willing to pay for a lawyer if necessary. 

 

PLEASE DO NOT CRITICIZE MY DAD.

Nothing a Lawyer can do, depends on whether the Consulate determine it to be a Misrepresentation.

Accurately fill in the DS260 when the time comes. 

If it was a politically motivated incident against a repressive regime they do have flexibility in how it is assessed by immigration.

Not really, because technically he signed it saying it was correct. Either you or he should have confirmed that at the time, too late now, all he can do is explain when he is asked about it.

DON'T make stuff up. That is intentional misrep and that's when you get serious bans. If they ask about it be honest about what happened when you filled it in.
