Prescribing guidelines for opiates has definitely changed in the 20 years I've been practicing nursing.  More so over the past 5 years than any other time.

Applicants are not the ones who get to decide what is material or not.

In this particular case, answering yes may or may not impact the end result.

 

Also, some important words were missing from the 30g aspect: "single offense". The OP's case does not appear to be a one-time incident, as such that exemption as codified does not apply.

There's also the aspect of transferring it to somebody else, which borders on other offenses (re: transportation and such).

In an extreme case, imagine it wasn't an IR, and imagine it wasn't given for free. (Fairly) Clearly that would be an issue. As to how those 2 factors matter, I'd have to defer to both federal and state laws as I am not certain myself.

Well at least you agree that it's more complicated than your initial post suggests. But since you want OP to bare her soul, self-incriminate, and leave it all to the beneficence of USCIS, where would you draw the line on honest-to-God disclosure? Would you disclose:

  • Extramarital affairs that meet the definition of bad moral character, for which you weren't caught and swore later to be faithful?
  • Soliciting prostitution (doing so more than once is a bar on naturalization!)
  • Intent to commit certain serious crimes in the heat of the moment, which you later reconsidered (intent can be a crime)?
  • That time you cheated just a little bit on your taxes, even though the IRS didn't flag it?

[Note: I'm not saying anyone should do any of the above!]

I'd answer honestly and "within reason" (i.e. jaywalking and speeding and such are not reasonable).

Intent would not be an issue unless there were actual, serious plans or actions associated with it (conspiracy to commit a crime).

Edit: With regard to the OP's case, it may or may not be material, hence the need for disclosure.

No judgement here and not to add to your concerns but one of the questions on the approval form at the ceremony is about engaging in polyamorous relationships. You will be required to disclose and sign that what you are stating is true. I don't know the legality surrounding them (I believe it is pretty gray) so it would be worth perhaps seeking advice of a legal professional. I was never asked in person (it doesn't apply to me) but I could have sworn the question was asked on multiple forms throughout the immigration process (although I could be wrong). It is definitely on the form you hand over and check yes or no to at your ceremony and you will also be asked directly by the officer.

Do you remember seeing it asked on other forms throughout the immigration process? I was never asked in person until the ceremony but I could have sworn it was asked before on other forms throughout my journey, It seems very odd if the only time it came up was on the N-445. If it was on other forms, my concern would be the OP had stated 'no' to the question. Even if they are not engaging in polygamy now it would be seen at the time as giving false testimony to obtain immigration. EDIT: Seems it has to be marriage to multiple partners so I guess it doesn't matter

Ahh in that case then if it has to be marriage the OP should be ok. OP if you are consulting a lawyer anyway regarding the cannabis issue it's worth just mentioning it.

I don't know if you've filed for N400 yet or not but if you haven't I think your best bet would be to hold off on filing for citizenship until cannabis is recreationally legal federally; it will happen eventually. That way you won't have to worry about problems with N400. Also Kratom which is legal federally but is illegal in some states helps with pain. Just something to think about. I know someone with Fibromylagia and it helps her phenomenonally.
