Clarification on I-130 eligibility

Hello everyone,

 

I am really confused. I am on the USCIS website right now searching for information regarding bringing a family member to the US.

Specifically my mother. I am preparing for future reference however I am uncertain if I can start applying now, or later on when I am a US Citizen.

 

The content of this link (https://www.uscis.gov/family/family-us-citizens/bringing-parents-live-united-states-permanent-residents) it says:

"To petition for your parents (mother or father) to live in the United States as green card holders, you must be a U.S. citizen and at least 21 years old. Green card holders (permanent residents) may not petition to bring parents to live permanently in the United States."

 

However for this I-130 link( https://www.uscis.gov/i-130) it says:

"Use this form if you are a citizen or lawful permanent resident of the United States who needs to establish their relationship to certain alien relatives who wish to immigrate to the United States"

 

Could someone pleas explain or clarify?

Must be a citizen to file IR5 for parents. 

 

Can file as LPR for spouse or children

only USC can file for parents, you will need to send proof that you are a USC with the i130

 

both statements are correct,  a USC qualifies to file for parents now you will have to establish that who you say is your mom is your mom,

 

you will need a copy of your birth certificate where your mom's name appears and a translation into English of said document, as well as copies of her marriage certificate or divorces if there are and translations into English

The I-130 is a multi-purpose form. LPRs can bring spouses, minor children and unmarried adult children. USCs can bring spouses, parents, siblings and all of their children (married and unmarried). For all of those cases, the same I-130 is used.
