Hello. I wanted to ask this question because I got a RFE which I replied to but I'm feeling very nervous. In 2017, I met my late fiance early that January in DR. We dated over the course of that year with me visiting 4 times total. I filed for him to join me in Aug of 2017. Unfortunately, during my last visit to the DR in December of 2017, he got very sick. He died December 25th of 2017. I was working with a company to file all of the paperwork for his petition. When he died, I was very grief stricken and told the lady assisting us with the paperwork and she told me she would take care of cancelling the petition. In March of 2018, I received an approval for his petition. I called her back and again, she said she took care of it. December of 2018 I met my current fiance. In March of 2019, he proposed to me. In April 2019, I filed for him. I received an RFE stating I should ask for a waiver and provide proof of death for my previous fiance. I did not have a death certificate but I had multiple conversations between my late fiance and I the days he was in the hospital leading up to his death in addition to conversation between his daughter and I during his illness before and after his death. I also had conversations between some of his friends and I who messaged me to give condolences. I submitted all of this along with a letter asking that they excuse my previous petition without a waiver due to the fact that it was approved after he died and due to me requesting to cancel it after his death. I don't know if I should have just requested a waiver. Someone please advise. Thank you.

There is no excuse from the waiver,  but a simple waiver request was all you needed to do

Is it possible that they will send me the request again or just deny it all together. It's sad to think that petition would be held against me even though he died before it was ever approved.

Waivers are given all the time.  All you needed to do was ask.  You of all people have a reason for one to be given

So now what?  I replied 2 weeks ago. It's like reliving one of the most painful experiences of my life and them possibly being being punished for giving the wrong answer. Any suggestions. I feel sick daily when I think about it all.

Our petition was approved today! God is good, he is just and he is faithful!

I think they granted, however, excused or granted doesn't matter,  your over the hurdle
