Hi guys,

I am really confused, i am at NVC stage of my IR1 application.  I was suppose to upload my documents but i got to realize  that my divorce  decree is not properly register with the Nigeria High court. I went to the court to get it register but they said it cant be done. How do i go about it. Should i just upload it like that..

April 28, 2011: Received NOA1 via text/email, file routed to CSC (priority date April 25th)
April 29, 2011: Updated
May 3, 2011: Received NOA1 hardcopy in mail
July 26, 2011: Received NOA2 via text/email!!!
July 30, 2011: Received NOA2 hardcopy in mail
August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

July 23, 2025:  Filed N-400 online

You’re not legally divorced.  Which means yoir marriage?  Invalid

The above is correct.  If you do not have one of those, you were not free to marry, and your marriage will not be recognized as valid by any Consular Officer.  No valid marriage, means no visa.

Amazing.  Slipped through.

 

Options?  Finalize the divorce and start over?  It can’t be back-dated at the court to before the new marriage.

I wouldn't be surprised to learn we're missing something here, but the OP and the petitioner need to understand that it makes no difference how "married" they consider themselves to be or how "divorced" they were before they married.  It only matters what US Consular Officers or USCIS consider divorced and/or married, for US immigration purposes.  If the foreign spouse's previous marriage was noted in the I-130 petition, then the existing divorce decree has already been seen in the petition approval process.  If it is NOT the proper document, it doesn't matter if USCIS made a mistake in accepting it.  A Consular Officer will not.  USCIS does not issue spouse visas.  Consular Immigrant Visa Units do.

What kind of decree do you have?

Read through this.  Was your divorce decree a “Decree Nisi” issued by the High Court?  You might be OK.  DOS says you are “free to marry” after 3 months.  There are other accepted types of decrees.  At this point best to upload what you have.

Saw that.  

Not as straightforward as the original post implied.  

I don’t know much about Nigeria except for the royal family members who periodically need my help to smuggle billions out of the country.  For a fee.

HOPEFULLY the OP’s document falls into one of the listed categories.
