I petitioned for my husband in March 2016. We had our first interview on November 8 2016 and we did the stoke interview on January 31, 2017. 

Now on May 10, I receive a NOID stating us we had discrepancies in our answers.

I am on public housing with my parent which I never removed myself from till date even though I am married.

I choose to keep this address because my son which I had for another man during this marriage stays mostly with my mother. I admit to the fact that I cheated on him.

 

My question is now that we received this NOID  stating the discrepancies and asking us to provide supporting documents, evidence and legal arguments on the RFES, why I have my driver license with the address that they find out from the USCIS record that I still live at my parents section 8 housing, does that affect his success in the process? This is where my son goes to school and I need proof of address there

 

They gave us 30 days to show that our marriage was not entered to evade immigration law by providing response 

 

We have around 10 documents altogether and around 8 affidavits of support letter.

I’d say get of VJ and get a competent immigration attorney. After a Stokes interview, the do it yourself boat has sailed. Time to bring in the big guns = attorneys.

 

Yes the discrepancies in your address affect the situation of course. Keeping your name on Section 8 housing while not living there also implies you’re dishonest. USCIS don’t know your heart, they can only go by the data they collect and the interview and from what you’re telling us, they are justified in questioning the legitimacy of your marriage.

 

Your evidence doesn’t convince me, so I can understand why it didn’t convince them. Filing taxes separate etc, and that’s AFTER a Stokes interview, who does that knowing you’re already being viewed suspiciously?

 

I wish you the best, it doesn’t look good, at all.

Agree with the above that it doesn’t look good. Too many things don’t make sense. Towards the end of last year you changed the life insurance arrangement, the bank account and then shortly thereafter filed taxes separately. Looks like you are covering your tracks. Meanwhile you have kept your name on a section 8 apartment. Are you also claiming benefits from welfare that are for single mothers? Is that why you are still on the section 8 housing documents? Are you trying to convince one arm of the government that you are a struggling single parent who needs public assistance but at the same time trying to convince another arm of the government that you are happily married and seeking an immigration benefit for your husband? 

 

Stokes interviews are rare and only conducted when there is some suspicion that something is not right. For two people who are apparently living together your evidence is weak. Most of us have stronger evidence when we live in separate countries. 

 

Are you saying you have an address on your drivers license where you don’t live? So many issues here.

We will be meeting with an attorney today to see our possible options. I am just so curious about it because he still goes to school and wont be done until next year. His working permit has expired last week. Please what more evidence do you think we need at this point?

Yes i kept the address since we were married because that is where my son stays with my mother. We all on section 8 except for my husband though he spent 3 days out of 7 days there too. Its close to his school. Please do you think if we have strong documents and i amend current tax return, will that be enough with the help of an attorney explaining our situation?
