Hello all,

 

I am a US citizen, new to the VJ Forums. Here's my story, I became a US permanent resident through my US employer and a few months back I became a US citizen. I would like to start a petition my parents, but I don't know where to start. At the moment, I cannot after to hire an immigration lawyer, because their rates are over the roof. In addition, my friends told me that the forms are long, but easy enough for me to fill them out. After some research, I know have to fill out forms I-130 and I-485. Nonetheless, my parents case will be kind of unique, let me explain. My parents arrived to America back in year 2000 with a tourist visa (I think is called B2 visa), they overstayed their visas and since then they have been living in America. They have their I-94 forms. In addition, apart from overstaying, they have never committed a crime. My questions are the following:

 

  1. Should I file the forms I-130 and I-485 at the same time?
  2. Should I file any addition forms? If so, in what order do I have to fill out the additional forms?
  3. When should I file form I-693 (Report of Medical Examination and Vaccination Record)?

2. Yes, I-765 EAD and I-131 AP

3. Closer to when the I-485 being approved. 

 

19 years, really? You will need proof that they entered the US legal the last time in 2000. If you have that proof, and since they are classified as immediate relative, their visa overstay, regardless of how long, is considered forgiven.

Out of status for 19 years means you need a lawyer.  If it is as Cap Janeway says, then the lawyer will not be as expensive as you think.

Thank you all for the helpful information. I checked several lawyers rates around my area and their rates are about $3000 each (one for mother and one for my father) and that's not including the USCIS fees, I think those rates are ridiculous. Plus, I was reading the instructions for forms I-130 and I-485 and it doesn't look difficult to fill out, it just a lot of questions. Yes, unfortunately they have been out of status for 19 years. Thankfully they have their I-94 form which means they entered the country legally. I have two additional questions.

 

  1. Can I first fill out and send the form I-130 and then after a month or two send the form I-485? (I'm asking this because, at the moment I only have the money for both I-130 forms, but only for one I-485, I'm still saving for the other I-485 form).
  2. According to the VJ Forums, I can translate their birth certificates myself as long as I follow a certain format and sign a certification statement, is this information correct?

Once again, all of your help is tremendously appreciated.
