File DCF in London ASAP and hope that you can still do it before they stop accepting petitions.  If they refuse it, then you'll have to file the I-130 in the US and wait 7-9 months for the petition to be approved, then a few weeks after that the police certificates and other documents will need to be uploaded.  If the explanation you submit for not having a police certificate for China is not acceptable, you may have to go to China to get one.  Why do you think that a visa to visit China would be denied?  Did she do something while living there that is cause for concern?

I will send the documents on Wednesday, I hope it's not too late.

Nothing bad happened in China at all! I am confident will will be accepted if we travel back. But as we know, visas are not granted 100% of the time and I'm just trying to think of every single possibility :)

Let's see how long this DCF CR-1 takes! 😀

Thanks for those 2 links payxibka + dragon fruit:
One of the few criteria for getting the police check is having the 'temporary residence registration' from when you registered with the police in China.
We simply don't have it and without it we can't get a police check.

Just like my first post, on one of the sites I see there is some US law that shows it can be waived:

So we will get an affidavit from my wife saying she did not commit any crimes, the letter from the company saying she didn't, and hope for the best.

If at the interview, the CO doesn't accept this, and says we have to go to China to get it, I wonder what happens if our Chinese tourist visa is denied... 😂

Hi, how did it work out for you? The letter from employment worked? I can’t obtain PCC either

Since you have a M visa, which does not grant residency, you would not qualify for DCF.

The company/places worked for did not help at all.
But of course, I need a police certifcate, OR a waiver.

I saw someone recommending this website - https://lawandborder.com - and yes, they were great, helped and gave us a very good waiver document.

Gary and Jim dealt with us very well.
At the interview to get the CR1 approved, the waiver worked perfectly. Certainly money well spent!

If I had simply said 'I tried everything I could but I couldn't get a police certificate from China', I don't think they would have been happy.

@ahiann8 what kind of waiver documents need to be prepared ? I wonder if a statement explaning the effort I made would help? Suchas the way/method I tried to obtain. Can u pls tell me what kind of waiver documents ?

Hi @BigShirmp - hope not too late.
I am not sure a statement from myself would have worked. And I wouldn't wanted to have risked it.
So, like I said above, I used lawandborder's services and they produced an 'explanation' that was enough for the interviewer to waive the police check.

We had to give lawandborder passport scans so they can see the visa pages, and police registration papers you have (we couldn't find ours, which was the problem, it's why we couldn't obtain a real police check) and the payment of course. Quite a simple process, it took a few weeks.

We're in the USA now, so it all worked fine!

Let's see how long this DCF CR-1 takes! 😀

HI there - my spouse and I just used https://www.chinatraveldocs.com/ to help us with getting my spouse's police cert from China.  It was not easy but Pete was excellent and helped with each step along the way.  It would have been impossible for us to go there and in person and Pete worked with us 100% remotely.  Has been keeping in touch regularly on status and we'll be receiving our hardcopies in the next week or so - he's already sent pictures of the docs in hand.  A big check off a long list.   Hope you are having good luck with it and reach out to https://www.chinatraveldocs.com/ if you need help!

FYI, London office stopped accepting I-130s as of April 1st. Not sure what visa you are applying under, but I know they were not accepting as of that date.
