Hi guys. I have 3 questions:

1). I am guessing that if I need a sponsor then they will have the same requirements for income as me? I cannot combine our incomes to meet the requirements?

2). My daughter is still in the Philippines but would not currently be in my household size until she comes to the US. I am not petitioning her because I just need to report her birth abroad and then she can come here as a US Citizen. How would she factor in to my household size for the purposes of the IR-1/CR-1 process?

3). When researching this I saw that the income requirements for household size includes past sponsored people? I imagine this wouldn't count for my ex-wife who I petitioned many years ago?

Thanks, sorry I know it's complicated.

  1. You can only combine income with qualified household members.  If your income/assets or combination thereof is below the required threshold for your household size, then you will need a join sponsor.  A joint sponsor must meet the guidelines for their household size.  This can be found by referring to the most current edition of the I-864P.
  2. Minor children always count in household size regardless of current living circumstances.
  3. Your ex-wife counts unless one of the following applies:  she is now a US citizens, she can be credited with 40 quarters of work, she has left the country and surrendered her green card, or if she has passed away,.

Thanks for your thorough answers! For question #1 if I lived with my parents in the same house and they have their own income, would i combine with them at all?

I have 3 children, 2 live with my ex wife in the US and the other in the Philippines with my new wife. Thanks.

So for me, my household size would be me, my wife, and my 3 children for a total of 5? If my parents are included on household size then it would be a total of 7 with their income combined with mine?
