Hello Everyone!

My Fiance had her interview today at the Islamabad Embassy. This is the first time she has gone for the interview. She has provided all the documentation was asked for but there are majority documents that was asked for they did not kept it. So, only thing they kept is the IRS transcript for last 3 years. They also asked her our relationship questions which they said they are had no issues with. So my guess is they are doing further investigation to see if they find any problem or no? I am not sure. I was born in Bangladesh but I'm a citizen of the US and been living here for last 11 years. They did questioned about how we met and my fiance explained them and they said OK. 

 

My Question is to all of you whom are way more knowledgeable than me. Please advise what could be the problem. I checked the stats online on the bottom the screenshot of it. It says it will take about 60 days or more resolve this issues. Very frustrated as you can tell. we had a denial before on USCIS end not able to show that we have met before we apply. But this time we had all the evidence and pictures of us spending lots of time together. I have been in Pakistan Last year, and we had engagement ceremony there and had loads of pictures of that as well with family members. Please kindly advise.

The bolded section above is most likely key issue. When it comes to USCIS, they don't care about ceremonies/parties... but the embassy does. They know a lot of local tradition/customs, and to them most likely you appear "too married" for a K-1 visa, but not "married enough" for a spousal visa

11/08/2016 : Interview - APPROVED!

11/23/2016 : POE - Dallas, Texas

From sending of I-129F petiton to POE - 146 days.

 

02/03/2017 - Married 

02/24/2017 - AOS packet sent

06/01/2017 - EAD/AP Combo Card Received in mail

12/06/2017 - I-485 Approved

12/14/2017 - Green Card Received in mail - No Interview

Thank you soo much. That's the only thing I could think of as well. I am not sure what step they would be taking to figure out it was a simple engagement in a restaurants. Just close members were involved from her and my side.

On the interview confirmation letter asked for last three years of tax return and w2 and transcript shows all the outstanding balance are paid to IRS. and Employment Verification Letter and Paystubs. My fiance took all that info but they only kept the 3 years of transcript and nothing else out that section.

Well if it were simply in AP it owuldn't be an issue, but if in fact CEAC does state "Refused" then, unless there's some other issue that we don't know about, that has been an issue that has caused a lot of denials in the past. It's kind of a tricky thing because it shows commitment, but in some customs it also basically means you're married.. so it's something people have to be aware of.

Id be grateful if you mention years? Did they keep 2018’s tax transcript?

I am very anxious and don't know what to expect from them. They did not keep her passport as well. only kept a copy of her passport and birth certificate and told her "that you are okay from your side, we will have to do our part" I do not what does that mean!

Yes, they kept for last 3 years. and last year was included.

Two things that I would be concerned with:

 

In your other post you mentioned they did NOT keep the passport.   This is not common for AP in Islamabad.  They typically keep the passport even if the AP is a year or two.

 

The second is the Refused status.   This status is common if they requested something but you mentioned they did not ask for any additional documentation.  Unless they end up sending the questionnaire...

 

K-1s at Islamabad are rather difficult to begin with.  If your "celebration" looked like a wedding that could be the major problem.   

 

It may take a few weeks but if the CEAC changes to "Returned to NVC" you'll know for sure the case is returned.

Yes, we were dressed up! I am thinking the same thing here but my fiance explained that it was done in a restaurants and we had family members there with us on that dinner.  Another thing that I noticed today that "www.ustraveldocs.gov'" on that personal login page where you schedual your interview, it states that they kept her passport but actually they did not keep it. 

 

It may take a few weeks but if the CEAC changes to "Returned to NVC" you'll know for sure the case is returned.

em in same situation...was scheduling ur interview by urself caused it? they took my original passport too..at end got white slip showed case is refued for AP..and ceac status showed refused too.. what does it mean? am i get rejected or it still in AP as mentioned on that white slip?

Hi,

Since the interview April 15th, I still have same status as "REFUSED". NO updates since then.

What should I do? Any Idea that may help. I have contacted them ( means Islamabad Embassy) they say all the time its send back to USCIS for REVOCATION, BUT when I reached out to NVC and USCIS, they said the case is still with ISLAMABAD EMBASSY, I should asked them about the case. It's so confusing and very frustrating. Any suggestions would be appreciated.

Refused usually means they need information from you.   They must have not updated your CEAC and your case is still with them.   It took my case a while to actually be returned but it was only about a month or so.  Have you contacted your local senator or congressman?  I would have them inquiry to the embassy.  The Senator has been able to get me more detailed responses.

It may take a few weeks but if the CEAC changes to "Returned to NVC" you'll know for sure the case is returned. It is returned to NVC and now they have send it out to USCIS to do further reviews. But I am still confused why and what are the reasons. 

 

Only thing I can think of is my previous K-1 application which was denied from USCIS because of one condition was not met.

Now the last time I called NVC they said it was sent out on August 26th to USCIS for further reviews. On CEAC it still shows "Returned to NVC".

Anyone with better understanding of the case, please advise.
